Will of Benjamin Dutton of Eastbourne

I Benjamin Dutton of Eastbourne in the County of Sussex carpenter being of perfect mind and memory and calling to mind and duely considering the uncertainty of human life make this my last Will and Testament. First and Principally I commit my soul into the hands of my blessed maker trusting in his mercies and in the merits of my dear redeemer for the remission of all my sins. My body I commit to the earth to be decently buried at the discretion of my executor hereafter named. As to my temporal estate I bequeath and dispose of it in the following manner. First I give and bequeath to my daughter Mary Dutton the dwelling house late Thomas Heeys and before Erles also one hundred pound of lawful money to be paid out of the money arising from the produce of the hutches and groyns. Also I give and bequeath my son Huddard the house and premisses scituated at the seaside in Eastbourne and the dwelling house late Thomas Dennis’ also a dwelling house and barn late Thomas Erles also the sum of one hundred and fifty pounds of lawful money arising out of the hutches and all cattle corn husbandry utensils and to discharge all rents that shall be due at my decease. Also I give and bequeath to my son Benjamin all my household goods shop goods timber tools lead and glass to look after the hutches and groyns and to receive the salary as it becomes payable and to discharge all debts. Also I give and bequeath to my loving wife the sum of ten pounds of lawful money. And I do hereby nominate and appoint my brother John Dutton, Physician and Surgeon at Lindfield in the County of Sussex and James Bellingham of Ho....? in the said County of Sussex Gent to be joint executors to this my last Will and Testament and I do hereby utterly revoke disallow and disannul all former bequests Wills and legacies by me heretofore in any wise left or made declaring ratifying and confirming this and no other to be last Will and Testament. In witness whereof I have hereunto set my hand and seal this sixteenth day of April one thousand seven hundred sixty and four. Benj Dutton junior.

Sign’d seal’d publish’d and declar’d by the within named testator Benja: Dutton to be his last Will and Testament in ye presence of us who subscrib’d our names in ye presence of the said testator. George Chapman; John Gearing; Chas? Mason.

7th Jan’ry 1765. Then was sworn John Dutton one of the executors in this Will named to whom the burthen of the execution thereof was committed (power being reserved of granting the like Commission to James Bellingham when &c. By us Ed Lund, Surr.
