In the Name of God Amen I LUKE HAMMOND of the Parish of WEST CHILTINGTON in the County of Sussex Yeoman being in Good Health of Body and of mind and of perfect mind and memory praise be therefore Given to Almight God calling to mind the uncertainty of life and being willing to dispose of that Estate wherewith it has pleased God to bless me Do make and ordain this my last Will and Testament in manner following (that is to say) I commend my Soul unto the hands of Almighty God who gave it and my Body to be decently buried at the discretion of my executors in trust hereinafter named And as for my worldly Estate Lands Goods and Chattles I give devise and bequeath in manner following.

First I will that my Executors in Trust should pay and discharge all my Debts and Funerall Charges out of my Goods and Chattles Except that the mortgage I have on that Copyhold called CLAYS OTHERWISE SHORTS herein after mentioned Likewise my will meaning and Desire is that my Executors in Trust should advise and consult one with the other What may be best to be done with my Copyholds Lands and my Farms (that is to say) in the selling of them during the minorities of my Dear children And what my Executors in Trust shall think best to be done with them or any part thereof I do hereby Will and appoint unto them full power and Absiolute Authority to do with my Copyholds Lands and farms in selling of them During the Minorities of my Children as aforesaid And that my Executors in Trust will as my Children shall come to their Respective ages of twenty one years perform to my Children As I shall give devise and bequeath unto them (that is to say) in manner following

Whereas I have Surrendered into the Hands of the Lord of the Mannor of NYTIMBER in the parish of WEST CHILTINGTON aforesaid All that my Customary or Copyhold messuage or Tenement Two Barns and Thirty Acres of Customary Land (more or less) with the appurtenances called CLAYS OTHERWISE SHORTS which I lately purchased of JOHN WOOLVERIDGE to such person or persons and for such use and uses and for such Estate and Estates Intents and purposes as in and by my last Will and Testament in writing should declare direct Limitt and appoint of and concerning the same Now in pursuance of such surrender I do hereby Give and devise All that my aforesaid customary or copyhold messuage & tenement Lands called CLAYS OTHERWISE SHORTS with the appurtenances unto my Eldest son LUKE HAMMOND his Heirs and Assignes At his Age of twenty one years Subject nevertheless to the Late Mortgage also hereinafter mentioned of and concerning the same which said Mortgage thereof was by me made to WILLIAM LEVERETT of THAKEHAM in the said County Cooper for three Hundred pounds and the growing Interest which I would that my Executors in Trust t Take the Rent orprofit thereof and pay the Interest as is shall become due and payable and what shall be over and above the said Interest to be paid out for board and Education untill my son LUKE HAMMOND shall attain or accomplish the full age of Twenty one years. But if it should happen that my son LUKE HAMMOND should die before he comes to the age of Twenty one years The I give Devise the aforesaid Customary or Copyhold Messuage or Tenement called CLAYS OTHERWISE SHORTSwith the appurtenances unto my son CLEMENT HAMMOND his Heirs and Assigns for ever at his Age of Twenty one years Subject nevertheless to the said Mortgage as aforesaid

Likewise I give and bequeath unto my Daughter ELIZABETH HAMMOND the sum of one Hundred and Fifty pounds of Good and Lawfull money of Great Britain to be paid unto her out of the moneys Arising from my Goods and Chattles At her age of Twenty one years and the Interest thereof to be paid out for her Board and Education Likewise I give and bequeath unto my Daughter SARAH HAMMOND the sum of one Hundred and Fifty Pounds of like lawfull money to be paid unto her out of the money arising out of my Goods and Chattles at her age of Twenty one years and the Interest thereof to be Laid out for Board and Education But if it should that either my Daughter ELIZABETH HAMMOND or SARAH HAMMOND should Die before they are or shall attain or accomplish Either of their full age of Twenty one years then her Legacy before Given shall be Equally Divided unto my Two Sons and Daughter and payable as they shall come to their Respective ages of Twenty one years But if it should happen that Both my Daughters should die before they come to their Ages of Twenty one years then their Legacys to be Equally Divided between my Two sons LUKE HAMMOND and CLEMENT HAMMOND as they shall come to their Respective ages of Twenty one years.

Whereas I have surrendered into the Hands of the Lord of the said Mannor of NYTIMBER in the Parish of WEST CHILTINGTON aforesaid All that my Customary or Copyhold Messauge or Tenement called FRYERS together with the Barn Hovel and Gates And all Those Crofts and Closes of Land thereunto Belonging and Appertaining Containing by Estimation Eighteen Acres or there abouts be the same more or less with the Appurtenances Lying in WEST CHILTINGTON aforesaid Which I lately Purchased of EDMUND BARNARD to such person & persons and for such use and uses and for Such Estate and Estates Intents and Purposes as in and by my Last will and Testamentin Writing should direct Limitt or appoint of and Concerning the same Now in pursuance of Such Surrender I do hereby Give and Devise All that my aforesaid Customary or Copyhold Messuage or Tenement Lands called FRYERS with the appurtenances unto my son CLEMENT HAMMOND his Heirs and Assigns for ever at his age of Twenty one years Subject nevertheless to the Contingency hereinafter mentioned of and Concerneing the same Charged and Chargeable nevertheless with the payment of the sume of Six pounds and Ten shillings of Lawfull money of Great Britain Yearly to be paid after my decease out of the yearly rent or Income thereof without any manner of Deduction or abatement in taxes or other matter or thing whatsoever and payable unto my Executors in Trust that it may be laid out for the board and Education of my Two Daughters ELIZABETH HAMMOND and SARAH HAMMOND to wit unto Each of them the sume of Three pounds Five Shillings a piece yearly Untill they shall come to their Respective ages of Twenty one years And also the further payment of the sum of Two Hundred pounds of Good and Lawfull Money of Great Britain inPart of the portions or Fortunes of ELIZABTH HAMMOND and SARAH HAMMOND my Daughters to wit to Each of them the sum of one Hundred pounds a piece to be paid unto them at my son CLEMENT HAMMONDs Age of Twenty one years And also the Further Payment of a Certain sum not Exceeding the sum of Fifty pounds Charged and Chargeable on the said Copyhold aforesaid If it should happen that my Goods & Chattles should not amount unto the sum of Three Hundred pounds before Given and bequeathed unto my Daughters ELIZABETH HAMMOND and SARAH HAMMOND share and share alike but if my Goods and Chattles should amount unto above Two Hundred and Fifty pounds after my Debts and funeral Charges are paid and not to Threee Hundred pounds then out of the Fifty pounds aforesaid Which is Last Charged on the Copyhold aforesaid shall be Charged with no more than what will make up the sum of Three Hundred pounds to be paid at my son CLEMENT HAMMONDs Age of Twenty one years Provided always and my will and meaning is and I do hereby will and Direct and appoint my Executors in Trust and the Survivours and Survivers of them and the Heirs of such survivors Upon trust only to Mortgage the Same Copyhold aforesaid and by Mortgage thereof to raise the said sum of Two Hundred pounds and pay the same to my said Daughters ELIZABETH HAMMOND and SARAH HAMMOND if my son CLEMENT HAMMOND should refuse at the Age of Twenty one years to raise and pay to them the said sum of Two Hundred pounds as aforesaid And also the further sum not Exceeding Fifty pounds if my Goods and Chattells should not amount as aforesaid or so much as shall make the sum of Three Hundred pounds But if it should happen that my son CLEMENT HAMMOND should die before he comes to the age of Twenty one years Then I give devise the aforesaid Customary or Copyhold messuage or tenement called FRYERS with the Appurtenances unto my son LUKE HAMMOND his Heirs and Assigns for ever at his Age of Twenty one years But if it shall Happen that my Goods and Chattles Doth amount unto more than the Three Hundred pounds after my Debts and Funeral Charges are paid as aforesaid All that shall be over and above the said Three Hundred pounds I give Devise and bequeath unto my son LUKE HAMMOND and CLEMENT HAMMOND to be Equally divided between them share and share alike as they shall come to their Respective ages of Twenty one years

Likewise I do Constitute and appoint my Brother JOSEPH HAMMOND of THAKEHAM in the County aforesaid yeoman and my brothers in law HENRY HULL of BURRYin the County aforesaid yeoman and CLEMENT HULL of WEST BURTON in the County aforesaid yeoman and my brother in Law CLEMENT UPPERTON of WEST BURTON aforesaid yeoman to be my Executors in Trust anf Guardians of my children during their Minorities And the Survivor and Survivors of them and their Heirs or Executors to see that my Last will and Testament fulfilled and Performed as is above Declared In Witness whereof I the said LUKE HAMMOND the Testator have hereunto set my Hand and Seale the Twenty Eight Day of September and in the year of our Lord One Thousand Seven Hundred and Fourty Four LUKE HAMMOND Signed Sealed Published abd Declared to be the Last Will and Testament of the said LUKE HAMMOND in the Presence of us Who subscribed our names as Witnesses in the Presence of the Testator ELIZABETH GRAY X her mark MARY SCRIVEN NATH[ANIE]LL WILMER

This Will was proved before the Reverend Mr JOHN HANCOCK Clerk Surrogate &c on the Twenty Second Day of February in the Year of our Lord One Thousand Seven Hundred nd Forty Eight By the Oaths of HENRY HULL CLEMENT HULL and CLEMENT UPPERTON Brothers in Law of the said Dec[eas]ed & the surviving E[xecut]ors in Trust the s[ai]d JOSEPH HAMMOND being Dead before he had renounced &c To whom &c well and truly &c sworn &c.
