Will of Mary Heather of West Grinstead

This is the last Will and Testament of me Mary Heather of West Grinsted in the County of Sussex Widow I bequeath my Household furniture and wearing apparel to Mary Wife of James Greenway absolutely I bequeath all the Residue of my Personal Estate and Effects unto my Brother Thomas Ewins and his Son Thomas Ewins the Younger their Executors and Admors upon trust to convert and get in the same and to invest the money to arise therefrom in the names or name of the trustees or trustee for the time being of my Will in or upon any of the public stocks funds or securities of the United Kingdom or any real security in England with liberty for the said trustees or trustee to vary and transpose the investments from time to time for any other Investments of the description aforesaid and upon trust to pay the Interest dividends and annual increase of my said Residuary personal Estate as and when the same shall become due and not by way of Anticipation into the proper hands of my said daughter Mary Greenway to be enjoyed by her as an unalienable provision free from the debts control or engagements of her present or any future husband and for which income the receipts of my said daughter Mary Greenway alone shall be sufficient discharges to my said trustees or trustee and after the decease of my said daughter then as to the principal of my said Residuary Personal Estate with the future Income In trust for my Grandson William James Greenway son of my said daughter absolutely to be transferred to him at his age of twenty five years but in case he shall die under the age of twenty five years without leaving a Widow or issue him surviving then as to the principal of my said Residuary Personal Estate In trust for such person or persons who at the decease of my same daughter shall be of her blood and of kin to her and who under the Statutes for the distribution of Intestates Effects would be entitled to her personal Estate if she were dead intestate and unmarried and I declare that my trustees or trustee shall apply the whole or such part as they shall think fit of the annual Increase to which my said Grandson will be entitled in and towards the maintenance education or otherwise for the benefit of my said Grandson during his minority and until he shall attain the said age of twenty five years I empower the Trustees or trustee for the time being of my Will to give receipts for all monies and Effects to be paid or delivered so such trustees or trustee by virtue of my will and declare that such receipts shall exonerate the person taking the same from all liability to see to the application or disposition of the money or effects therein mentioned I exempt every trustee from liability for losses occurring without his own willful and authorize him to retain and allow to his Cotrustee all expences incident to the Trusteeship I appoint the said Thomas Ewins and Thomas Ewins the younger to be Trustees and Executors of this my Will and revoke all other Wills In Witness whereof I the said Mary Heather have to this my Will set my hand this twenty fourth day of September one thousand eight hundred and thirty eight The mark X of Mary Heather
