Will of Michael Martin of West Firle

In the name of God Amen I Michael Martin of West Firle in the County of Sussex Gentleman do make publish and declare this my last will and testament in manner following (that is to say) first I give and devise unto my eldest son Joseph Martin of Beddingham in the County aforesaid yeoman all those my freehold and copyhold lands situate lying and being in the parish of Keymer in the said County of Sussex commonly called or known by the name or names of Franklands and Grove Lands containing by estimation ninety acres more or less now in the occupation of John Bowne his undertenants assigns the copyhold part whereof I have only surrendered to the use of my will to hold the aforesaid lands and premises unto him my said son Joseph Martin his heirs and assigns forever also I give and devise unto my daughter Mary Martin all those my freehold lands situate lying and being in the parishes of Hurstpierpoint and Bolney in the said County of Sussex commonly called or known by the names of pookhouse? and Bolney fields now in the tenure or occupation of John Matthew his undertenants or assigns to hold the said premises in Hurstpierpoint and Bolney unto my said daughter Mary her heirs and assigns for ever also I give and devise unto my son William Martin all those my copyhold lands and Hereditaments lying and being in the parish of West Firle aforesaid late [unreadable] and which I have also duly surrendered to the use of my will to hold the said copyhold premises in West Firle aforesaid unto my said son William Martin his heirs and assigns for ever upon the trust following that is to say upon past to pay the rents and profits of the said premises from time to time as he or they shall remain the same unto my daughter Jane the wife of John Langridge of West Firle aforesaid carpenter for and during the term of his natural life for her own use and maintenance independent of her said husband and not to be subject to his control debts or engagements and the receipt of my said daughter to be a sufficient discharge for the same notwithstanding her coverture and upon this further trust now and immediately after the decease of my said daughter Jane to surrender the said copyhold lands and premises unto the hands of the sons of the Lord of the Manor of whom or which the same are holden to the use of such child or children of my said daughter or other person or persons as would have been but customary Heir or coheirs of the said premises had she herself been seized thereof in fee simple according to the custom of the said Manor also I give and bequeath unto my said daughter Mary the sum of two hundred pounds and to my daughter Elizabeth Martin the sum of one thousand pounds and to my daughter Ann Martin the sum of one thousand pounds of lawful money of Great Britain all which legacies before mentioned I will and insist shall be paid to my said daughters respectively within three months next after my decease by my executors herein after named also I give and bequeath unto my son Peter Martin all and singular the household goods horses oxon (sic) cows cattle sheep hay corn stock and effects of what nature kind or denomination whatsoever which now are or at the time of my decease shall be in or upon or about and belonging to my farm at Exceat in the parish of West Dean in the County aforesaid as his own property and effects for ever also I give and bequeath unto my dear and loving wife Elizabeth Martin the sum of eight hundred pounds to be paid to her by my executors hereby after named within three months next after my decease and my will and mind is that the eight hundred pounds so as aforesaid given to her my said wife shall be over and above all [unreadable] and thirds which she may claim to have out of all and every or any of my lands and real estate or any part thereof and of every other right to my real estate or any part thereof to which she may be entitled by virtue of any deed of settlement or otherwise howsoever all the rest residue and remainder of my estates both real and personal not taken before by her? disposed of by this my will after payment of my just debts legacies aforesaid funeral expenses and charges of proving this my will I give devise and bequeath unto my sons William Martin John Martin and Peter Martin their heirs executors creditors and assigns for ever equally to be divided between them share and share alike and hereby nominate constitute and appoint them my said sons William John and Peter to be joint executors of this my will hereby revoking all former and other wills by me at any time heretofore made in writings whereof the said Michael Martin have to this my will contained in one sheet of paper set my hand and seal this fourteenth day of August in the year of our Lord one thousand seven hundred and seventy five Michael Martin so signed sealed published and declared by the said Michael Martin the testator as and for his last will and testament in the presence of us who in his presence and at his request and in the presence of each other have subscribed our names as witnesses hereto / Mich. This will was proved at London the eighteenth day of November in the year of our Lord one thousand seven hundred and seventy five before the worshipful Andrew Colter Durant Doctor of Laws and Surrogate of the Right Worshipful Sir George Hay Knight also Doctor of Laws Master Keeper or Commissary of the prerogative court of Canterbury lawfully constituted by the Oaths of William Marten John Marten and Peter Marten the sons of the deceased and Executors named in the said will to whom administration was granted of all and singular the goods chattels and credits of the said deceased they having been first sworn duly to administer.
