In the name of God Amen I John Sharpe of Northiam in the county of Sussex Esquire being sick and weak in body but of sound and perfect disposing mind and memory do make and ordain this my last Will and Testament in manner following that is to say as for touching and concerning my temporal estates I dispose thereof as follows Imprimis I give and bequeath unto my sister Jane the now wife of Stephen Odiarne of the ancient town of Rye in the county of Sussex aforesaid Gentleman the full sum of two hundred pounds of lawful money of England to be paid unto her within one year next after my decease by my executor hereinafter named Item I give and bequeath unto the said Stephen Odiarne my brother in law my chambers situate lying and being in the Middle Temple London together with all my furniture whatsoever now being in my said chambers and all my right and interest whatsoever in my said chambers with their and every of their appurtenances Item I give and bequeath unto my sister Catherine Sharpe the like sum of two hundred pounds to be paid her by my executor hereinafter named within one year after my decease Item I give and bequeath unto my niece Mary Gibbs the sum of two hundred pounds of lawful money of England to be paid her by my executor hereinafter named at the day of her marriage or age of one and twenty years which shall first happen together with interest for the same after the rate of five pounds per cent per annum And my will and mind is that the said sum of two hundred pounds and interest shall be continued in my executors hands for the use of my said niece Mary Gibbs without giving any amount for the same to any person or persons whatsoever till the time of payment above directed but in case the guardianship and care of my said niece Mary Gibbs be continued in my Executor hereinafter named then my will is that he may if he thinks proper expend and lay out the interest of the said two hundred pounds yearly towards her education and the same shall be allowed in his attempts further if my said niece shall happen to die within the age of one and twenty years and before marriage then I give the said two hundred pounds and interest unto my said executor Item I give and bequeath unto Mr Benjamin Bayley the sum of one pound to buy him a ring Item I give and bequeath unto my servant Thomas Sampson the sum of five pounds to buy him mourning The two last mentioned legacies to be paid within two months next after my decease Item I give unto Thomas Frewen Esquire the best horse I shall die possessed of Item I give devise and bequeath unto my loving brother Thomas Sharpe all the rest residue and remainder of my estate both real and personal freehold and copyhold whatsoever and wheresoever and his heirs and assigns to have and to hold the same unto him my said brother Thomas Sharpe and unto his heirs and assigns forever upon this condition nevertheless that my said brother Thomas Sharpe his heirs executors or administrators shall and will pay and discharge all and every the above given legacy and legacies as the same shall become due and payable together also with all and every my just debts funeral charges probate of this my will and all other incident expenses thereunto belonging and in case my said brother Thomas Sharpe his heirs executors or administrators do refuse to perform this my will then all my estate before herein given and devised unto my brother Thomas Sharpe I will give devise and bequeath unto my aforesaid niece Mary Gibbs and to her heirs and assigns forever she my said niece her heirs executors and administrators paying and discharging al and every the above given legacies together with my debts and all other expenses before in this my will specified and declared And lastly I make and ordain my said brother Thomas Sharpe my full and sole executor in this my last Will and Testament revoking and making void all former and other Wills by me heretofore made In witness whereof I have to this my last Will and Testament being written on two sheets of paper to each sheet thereof set my hand and seal this third day of January in the second year of the reign of our sovereign lady Queen Anne over England… in 1703 John Sharpe signed sealed published and declared by the said testator to be his last Will and Testament in the presence of us Samuell Petter of Dixter Thomas Higham Geo Bishop Probatum fuit …London … 22nd February 1703 … etc
