Will of Martha Hilder of Salehurst

This is the last Will and Testament of me Martha Hilder the Widow of Stephen Hilder late of Robertsbridge in the Parish of Salehurst in the County of Sussex ffarmer deceased made this twenty ninth day of May in the Year of our Lord one thousand eight hundred and twenty eight I direct my just debts funeral Testamentary and incidental expences be first paid I give and bequeath my wearing apparel to my daughter Ann the Wife of Henry Kennet of Clapham in the County of Surry to be delivered to her as soon as conveniently may be after my decease And as to all and every my ready monies and securities for money goods chattels debts effects and residue of my Personal Estate whatsoever and wheresoever I direct the same to be divided into four equal parts or shares which I give and bequeath as follows I give and bequeath one equal fourth part or share thereof unto my said daughter Ann Kennet in case she shall be living at the time of my decease and in case she shall depart this life in my lifetime I give and bequeath the said one fourth part or share equally between and amongst all and every the child and children of the said Ann Kennet that shall be living at the time of her decease share and share alike to be paid to them as they shall respectively attain the age of twenty one years and in case any or either of the children shall depart this life under the age of twenty one years leaving lawful issue such issue shall take the parent’s share but in case any or either of the children shall depart this life under the age of twenty one years not leaving lawful issue the share or shares of such children so dying shall go and be paid to the Survivors or Survivor of them equally and to whom I hereby in such case bequeath the same accordingly Also I give and bequeath one other fourth part or share thereof unto my Son William Hilder of Tenterden in the County of Kent in case he shall be living at the time of my decease and in case he shall depart this life in my lifetime I give and bequeath the said one fourth part or share equally between and amongst all and every the child and children of my said Son William Hilder that shall be living at the time of his decease or be born in due time after his death share and share alike to be paid to them as they shall respectively attain the age of twenty one years and in case any or either of the children shall depart this life under the age of twenty one years leaving lawful issue such issue shall take the parent’s share but in case any or either of the children shall depart this life under the age of twenty one years not leaving lawful issue the share or shares of such children so dying shall go and be paid to the Survivors or Survivor of them equally and to whom I hereby in such case bequeath the same accordingly Also I bequeath unto my Son Robert Hilder of Yarmouth in the County of Norfolk Spirit Merchant one other fourth part or share thereof absolutely but in case he shall depart this life in my lifetime I direct that the same shall be divided into three equal parts or shares and be applied in the same manner to all intents and purposes as the fourth parts or shares herein bequeathed to my said daughter Ann Kennet my said son William Hilder and the children of my late son Stephen Hilder are limited give and bequeathed and I also give the remaining one equal fourth part or share thereof unto and equally between and amongst the six children of my late son Stephen Hilder that shall be living at the time of my decease share and share alike to be paid to them as they shall respectively attain the age of twenty one years and and in case any or either of the children shall depart this life under the age of twenty one years leaving lawful issue such issue shall take the parent’s share but in case any or either of the children shall depart this life under the age of twenty one years without leaving lawful issue the share or shares of such children so dying shall go and be paid to the Survivors or Survivor of them equally and to whom I do in such case bequeath the same accordingly And my will and mind further is that Robert Willsher the younger of Etchingham in the said County ffarmer and my said son William Hilder (whom I have hereinafter appointed Executors of this my Will) or either of them their or either of their Executors or Administrators shall not be charged or chargeable nor answerable nor accountable for any more monies than they shall respectively actually receive by virtue of this my Will nor with or for any involuntary loss nor the one for the other of them or for the Executors or Administrators of the other of them but each of them only for his own acts deeds receipts and disbursements and also that it shall be lawful for them the said Robert Willsher and my said son William Hilder each of them and their and each of their Executors and Administrators to deduct retain and reimburse themselves and himself and to allow to each other by and out of my said Personal Estate all losses costs charges damages and expences which they shall respectively bear pay sustain or be put unto in acting as Executors to this my Will together with a reasonable Allowance for their and each of their Journies trouble and loss of time in and about the same and I do hereby nominate and appoint the said Robert Willsher and my said son William Hilder joint Executors of this my Will and do hereby revoke and make void all former and other Wills and Codicils by me at any time or times heretofore made In Witness whereof I the said Martha Hilder the Testatrix have to this my last Will and Testament contained in this and the preceding sheet of paper subscribed my name the day and year first above written _ Martha Hilder
