As is the will of almighty god of his goodness

My will is that all

Expenses and the costs and charges of proving this my will shall be fulfilled and fully satisfied by my executors here after named from and out of my belongings and estate.

And I give and leave to my son Walter Baker all that my messuages, tenements garden orchard piece or parcel of land and properties with their occupancies, estates standing and being in the parish of Hailsham of ever and …………

Occupation to hold the said messuages tenements garden orchard piece or parcel of land and premises with their occupancies unto my said son Walter Baker his heirs and assigns forever subject nevertheless to the use and occupancy by my wife Hannah Baker for and during the term of her natural life of the room or chamber in my said messuages tenement called the dining room and of the two sleeping rooms adjoining (being the north end of my said Messuages or Tenement without she my said wife being subject or liable to the payer for rents or taxes for or in respect of the same and I give and leave unto my said wife Hannah Baker and her assigners for and during the term of her natural life all that my messuage or tenement garden and premises with their occupancies situate standing and being in the parish of Hailsham aforesaid accordingly called a house by the name of the Stony Lane. House and uses in several occupation of Richard Wood and James Harris and now and after the decease of my said wife Hannah Baker I give and leave the same said messuage or tenement garden premises with their occupancies unto Thomas Lidbetter of Hailsham aforesaid shopkeeper and Matthias Slye of Westham in the said county gentleman and their heirs forever upon trust nevertheless that they the said Thomas Lidbetter and Matthias Slye or the survivor of their heirs or such survivor shall and do as soon as conveniently may be after the decease of my said wife Hannah Baker absolutely all and dispose of the said messuage or tenement garden and premises called the Stony Lane house with their occupancies for the best price or prices that can be had or gotten for the cause either by public auction or private contract and either together or as lots or parcels as the said Thomas Lidbetter and Matthias Slye or the survivor or of the and of such survivors shall in their or his discretion take most amount able and pay distribute and divide monies arising from the sale thereof together with the rents and ….. there afforded the terms of the demise of my said wife Hannah baker in the meantime and until the sale and distribution thereof and hereinafter occupying and directing the same and in order to facilitate the sale and disposal of the said messuage tenement garden or premises here in afore directed to be sold and dispersal I hereby expressly declare and direct that the purchaser or purchases there of and part there of or their heirs executors administrators or assigns shall be compelled or compellable to …. The applications of his her or their purchase money or purchasers monies or any part there of be answerable or accountable for the loss misapplication or non application there of or any pact thereof but that such purchasers or purchasers and his her or their heirs executors administrators and assigns respectively shall be absolutely discharged there from upon payment of such his her or their own purchase money or purchases monies unto the said Thomas Lidbetter and Matthias Slye or the survivor of them or the heir of such survivor any rule in law or equity to the contrary notwithstanding also I give and bequeath unto my wife Hannah baker for and during the term of her natural life the use possession and enjoyment to all my household goods beds bedding plates linen and china whatever and wherever and from and after her decease I give and bequeath the same goods beds bedding plate linen and china unto the said Thomas Lidbetter and Matthias Slye their executors and administrators forever upon trust nevertheless that they the said Thomas Lidbetter and Matthias Slye or the survivor of them or the executors or administrators of such survivor shall and do as soon as conveniently may be after the decease of my said wife Hannah Baker absolutely sell and dispose of my said household goods- beds bedding plates linen and china for the best price or prices that can be had or gotten for the cause either by public auction or private contract as they the said Thomas Lidbetter and Matthias Slye or the survivor of them or the executor or administrator of such survivor shall in their or his discretion think most advisable and the monies arising from the sale or sales there of together with the monies arising from the sale or sales of my said messuage or tenement garden and premises before directed to be sold and disposed of and the rents and profits of the same messuages or tenement garden and premises from the time of the decease of my wife Hannah baker until the sale and disposition there of to pay distribute and divide unto and amongst my children Walter Baker Mary Baker Ann Baker Thomas Baker John Baker William Baker and Sarah Baker in equal shares and proportions to and for their several and respective use and users and all the rest residue and remainder of my goods chattels effects monies securities for money rights credits and personnel and estate whatsoever and wheresoever after payments to my said just debts funeral expenses and costs and charges of proving this my will and not by use available before otherwise disposed of I give and bequeath unto the said Thomas Lidbetter and Matthias Slye or the survivor of them or the executor or administrators of such survivor shall and do as soon as conveniently may be after my decease absolutely sell and dispose of the same goods chattels effects and personnel estate for the best price or prices that can be had or gotten for the sale there by public auction or private contract as they the said Thomas Lidbetter and Matthias Slye or the survivor of them or the executor or administrator of such survivor shall in their or his discretion think most advisable and put and place out the monies arising from the sale or sales there of together with such debt or monies as shall be due owing or belonging to me at the time of decease at interest to some good and sufficient

Government or real security or securities in the name or names of the said Thomas Ledbetter and Matthias Slye or the survivor of the executor or administrators of such survivors and pay the interest and dividends unto my said wife Hannah Baker for and during the term of her natural life to and for her well being and benefit and for and after her decease to all in and receive the said interest principal monies so directed to be placed out at interest of aforesaid and pay distribute and divide the same unto my children Walter Baker Mary Baker Ann Baker Thomas Baker John Baker William Baker and Sarah Baker in equal share and proportions to and for their several and respective use and uses provided never the less and my will is that in case any or either of my said children Walter Baker Mary Baker Ann Baker Thomas Baker and John Baker William Baker and Sarah Baker happen to depart this life in the term of my said wife Hannah Baker leaving any children or child of their his or her bodies or body lawfully begotten then that there part or share part or share of them his or her dying or and in the whole of the monies here in before directed to be paid distributed and divided unto and amongst my said children Walter Baker Mary Baker Ann Baker Thomas Baker John Baker William Baker and Sarah Baker at the decease of my said wife Hannah Baker shall go and be paid to the children or child of such of them my said children Walter Baker Mary Baker Ann Baker Thomas Baker John Baker William Baker and Sarah Baker respectively as shall depart this life in the life time of my said wife Hannah Baker leaving children or child of their bodies or body lawfully begotten as aforesaid in equal shares and proportions if more than one to and for their several and respective use and uses and in case any or either of my said children Walter Baker Mary Baker Ann Baker Thomas Baker John Baker William Baker and Sarah Baker shall happen to depart this life in the life time of my wife Hannah Baker without leaving any children or child of their his or her bodies or body lawfully begotten then that the parts or shares part or share of them his or her so dying of and in the whole of the said trust and monies shall go and be paid to such of them my said children Walter Baker Mary Baker Ann Baker Thomas Baker John Baker William Baker and Sarah Baker as shall be living at the time of the decease of my said wife Hannah Baker in equal share and proportions if more than one to and for their several and respective use and uses And I nominate constitute and appoint the said Thomas Lidbetter and Matthias Slye joint executors of this my last will and testament and my will also is and I do hereby expressly declare and direct that they my executors and trustees or either of them their or either of their heirs executors or administrators shall not be charges or chargeable with or accountable for any more of my monies or estate than they shall respectively actually receive and shall come to their respective hands by virtue of this my will or with or for any loss that may happen of such monies or estate any part there of so is such loss do not happen by or though their or either of their wilful default or neglect or shall either of them my said executors and trustees become unable or accountable for the other of them unto deeds receipts defaults or disbursements executors of the other of them but each of them for his and for his own acts deeds receipts defaults and disbursements and further that it shall and may be lawful to and for my said executor and trustees and there heirs executors and administrators unto my will respectively they do as respectively from and out of my said monies and estate all such taxes costs charges damages and expanses as they shall respectively sustain pay and spend as be put unto the executors of this my will or trust hereby in the exposed or be put unto any other matters or things in any wise relating there unto and lastly I hereby revoke all former wills by me made and declare this only to be my last will and testament in witness where of I the said Thomas Baker the testator have to the four first sheets of this my will contained in five sheets of paper at my hand and in this the fifth and last sheet there of my hand and seal the fourth day of may in the year of our lord one thousand eight hundred and twenty

On the 29th May 1829 were swore Thomas Lidbetter and Matthias Slye the executors in this will named to whom was conducted the execution here there of the will. Thomas Lidbetter and Matthias Slye are also sworn that the goods chattels and credits of the said deceased more under the value of fifteen hundred pounds Under taken by use

Codicil to the will of Thomas Baker

This is a codicil to the last will and testament of Thomas Baker of Hailsham dated 4th May 1820 where I Have bequeathed unto my son Walter Baker the garden belonging to the house now in occupation, my wife is that a part of that bequest be revoked and I do hereby give and bequeath unto my wife Hannah Baker that part of the garden which is situated between the grass walk and the high road to have and to hold the same for and during her natural life and for immediately after her death to my son Walter Baker his heirs and assigners
