This is the last Will and Testament of me HARVEY HERRINGTON of WEST CHILTINGTON in the county of Sussex Blacksmith which I this day make and declare in manner following And whereby I give and bequeath unto my Wife FRANCES otherwise FANNY HERRINGTON all and every my Household Goods Furniture Plate Linen and Effects To have and to hold the same for and to her own use and behoof for and during the term of her life And the property of and in so much and such part thereof as she shall or may see good to dispose of for and during towards her decent maintenance during such her life Also I give devise and bequeath unto my said Wife all that and those my Copyholds of Inheritance situate and being at WEST CHILTINGTON aforesaid comprising my newly erected messuage Buildings Garden Close or parcel of land called JOHNSONS (or by other names) together with two bounded pieces in the SINNACK common field numbers two and five as well as all other my real and personal estate chattels implements of trade and husbandry ready money monies due to me on any kind of security securities and other property and effects whatsoever and wheresoever being and of what nature or kindsoever the same may consist To have and to hold unto her my said Wife and the full use rents interest profits or annual produce thereof for and during such her life she continuing to farm and use or to let the same as she shall see good and eligible And from and within twelvemonths after the decease of her my said Wife or of my decease in case I shall outlive my said Wife I give and bequeath all such my said personal estate goods furniture monies and other personal and moveable property or such part thereof as shall then remain unto and among my six children GEORGE HERRINGTON WILLIAM HERRINGTON JOHN HERRINGTON RICHARD HENRY HERRINGTON MARIA the Wife of JOHN SCUTT and SARAH the Wife of HENRY HAYLER to be equally divided between them share and share alike either by public sale or valuation as they shall agree and my Executors shall see good And from and immediately after my said Wife’s decease or my decease as aforesaid I give and devise unto my said youngest son RICHARD HENRY HERRINGTON all my aforesaid Copyhold estate or estates of Inheritance with all their rights members and appurtenances To have and to hold unto my said son his heirs executors administrators and assigns for ever Subject nevertheless and charged and chargeable with the payment thereof of one equal shore or sixth part in value thereof unto each of my five other aforementioned children within twelve months next after my said Wife’s decease or my decease aforesaid such valuation or appraisement to be made by one or more indifferent and competent person or persons and each of my said children paying an equal and proportionate part of the expences. And if any of my said children shall happen to die before receiving such their share then I give the same to their children in equal proportions share and share alike And if no such children shall be left them surviving then I direct that such respective share or shares shall lapse and belong to my surviving children or their lawful representatives in like equitable proportions And whereas my son GEORGE is now beyond Sea and should he not return to his native land or satisfactory account be obtained that he is living at the end of Ten years the date hereof it shall be construed that he is dead and will be heard of no more And in that case I direct that his said share or part shall be equally divided unto and among my remaining children or their representatives share and share alike and that such his share be reserved on the real estate until the expiration of such ten years from the day of the date hereof And I charge my said personal estate and in aid thereof my real estate with the payment of all my just debts and funeral and testamentary expences And I hereby make and appoint my said Wife and my son WILLIAM HERRINGTON and my Son in law JOHN SCUTT Executors and Trustees of this my Will allowing them all reasonable costs charges and expenses in this their trust And I hereby cancel and set aside all former and other wills by me heretofore made and do ordain this will […] only to be my last Will and Testament In Witness whereof I the said HARVEY HERRINGTON the Testator have hereunto set my hand this twenty sixth day of December in the year of our Lord one thousand eight hundred and forty eight - HARVEY HERRINGTON – Signed and declared by the said HARVEY HERRINGTON the Testator as and for his last Will and Testament in the presence of us who at his request and in the presence of him and of each other (at the same time) have subscribed our names as Witnesses CHARLES LEWRY WILLIAM CHARMAN.

Whereas I the undersigned HARVEY HERRINGTON of WEST CHILTINGTON in the county of Sussex Blacksmith have duly made and executed my last Will and Testament bearing date the twenty sixth day of December one thousand eight hundred and forty eight Now I confirm my said Will in every particular not hereby altered or revoked And further will and direct that whatsoever share personal property or effects I am or shall become entitled to and now in expectancy under the Will of my late uncle JAMES HERRINGTON SIMMONDS of STOPHAM in the said county be passed into and taken […illeg] And as part of my property as mentioned and directed in and by my said Will And from and immediately after my decease I give and bequeath unto my Son RICHARD HENRY HERRINGTON the clock now standing in my kitchen and one linen [clothes? ] chest also in my now dwellinghouse And I revoke the devise in my said Will to my said son RICHARD HENRY of my Copyhold estate therementioned and direct the same to be sold and equally divided unto and among my children as therein directed with respect to my other property as soon as maybe after the decease of her my said Wife or of my decease if I should outlive my said Wife. I also hereby appoint my said son RICHARD HENRY one of the executors of my said Will instead of my Son in law JOHN SCUTT therein mentioned or appointed In Witness whereof I have hereunto signed my name this third day of May in the year of our Lord one thousand eight hundred and sixty two – HARVEY HERRINGTON – Signed and declared by the said HARVEY HERRINGTON as and for a Codicil to his last Will and Testament in the presence of us who (both present together at the same time) have at his request and in the presence of him and of each other subscribed our names as Witnesses CAHRLES LEWRY JOB EDWARDS

Proved with a Codicil at Chichester the 28th day of September 1865 by the oath of WILLIAM HERRINGTON Son of the deceased one of the Executors named in the Will To whom Administration was granted. Power reserved for FRANCES otherwise FANNY HERRINGTON Widow the Relict of the deceased the other Executor named in the Will and RICHARD HENRY HERRINGTON the son the Executor named in the Codicil

The Testator HARVEY HERRINGTON was late of WEST CHILTINGTON in the county of Sussex Blacksmith who died on the 28th day of March 1865 at WEST CHILTINGTON aforesaid.
