Will of Peter Ayling of Treyford

In the name of God Amen I Peter Ayling of Treaford in the County of Sussex yeoman being sick and weak in body but of sound and disposing mind memory and understanding thanks be to God for the same do publish and declare this to be my last Will and Testament in manner and form following (that is to say). First I will and direct that all my just debts and funeral expences be fully paid and satisfied. Also I give and devise all those two pieces or parcels of coppice lands or hangers commonly called or known by the names of the Mill Coppice and Squal? Coppice containing together by estimation three acres (be the same more or less) situate lying and being in the parish of Treaford aforesaid and now in my own possession and also all those two pieces or parcels of meadow land commonly called or known by the several names of Brewtons Orchard and Mill Mead containing together by estimation one acre and fifty perches (be the same more or less) situate lying and being in the parish of Treaford aforesaid and now also in my own possession unto my brother Thomas Ayling his heirs and assigns to hold unto my said brother Thomas Ayling his heirs and assigns forever. Also I give and bequeath unto my nephew James Burton son of my sister Elizabeth Burton the sum of one hundred and fifty pounds of lawful money of Great Britain to be paid within twelve months next after my decease. Also I will and direct that my executor herein after named do and shall so soon as conveniently may be after my decease place at interest the sum of one hundred and fifty pounds of like lawful money and do and shall permit and suffer my neice Elizabeth Tribe wife of Richard Tribe and daughter of my said sister Elizabeth Burton to have receive and take the interest and proceed thereof for and during the term of her natural life and from and immediately after her decease I give and bequeath the said sum of one hundred and fifty pounds so to be placed out at interest as aforesaid unto and amongst all and every the child and children of the said Elizabeth Tribe that shall be then living to be equally divided between them share and share alike. Also I give and bequeath unto my sister Mary wife of William Collins the sum of one hundred pounds of lawful money of Great Britain to be paid within twelve months next after my decease. Also I give and bequeath unto my sister Elizabeth Burton one annuity or yearly sum of twelve pounds of lawful money of Great Britain for and during the term of her natural life to be paid her by equal half yearly payments the first payment thereof to begin and be made within six calendar months next after my decease. Also I give and bequeath unto my sister Johanna Tribe one annuity or yearly sum of twelve pounds of like lawful money for and during the term of her natural life to be paid her by equal half yearly payments the first payment thereof to begin and be made within six calendar months next after my decease. Also I give and bequeath unto my nephew Richard Ayling son of my late brother Robert Ayling the sum of five pounds to be paid within twelve months next after my decease. Also all the rest residue and remainder of my estate and estates both real and personal of what nature kind or quality soever within the Kingdom of Great Britain or elsewhere I give devise and bequeath unto my said brother Thomas Ayling his heirs executors and admors and if my personal estate shall not be sufficient to pay my debts annuitys legacys and funeral expences then I do hereby charge my said coppices and lands with the payment of so much thereof as the same shall fall short to pay. And I do hereby make constitute and appoint my said brother Thomas Ayling whole and sole executor of this my Will hereby revoking all former Wills by me at any time heretofore made. In witness whereof I the said Peter Ayling the testator to this my Will have set my hand and seal and have published and declared the same to be my last Will and Testament the tenth day of June in the year of our Lord one thousand seven hundred and seventy one. This Will was proved at London the twentieth day of July in the year of our Lord one thousand seven hundred and seventy one before the Right Worshipful George Hay, Doctor of Laws, Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of Thomas Aylwin otherwise Ayling the brother of the deceased and sole executor named in the said Will to whom administration was granted of all and singular the goods chattels and credits of the said deced he having been first sworn by Commission duly to administer.
