Will of Samuel Adams (Humphrey) of West Chiltington

In the Name of God Amen I SAMUEL ADAMS OTHERWISE HUMPHREY of the parish of WEST CHILTINGTON in the County of Sussex yeoman being of sound and disposing mind memory and understanding Do make and declare my last Will and Testament in manner following, that is to say, after recommending my soul unto Almighty God and my Body to the Earth to be decently buried at the discretion of my Executors hereinafter named I dispose of my worldly Estate as followeth, namely

I give devise and bequeath unto my son EDWARD ADAMS OTHERWISE HUMPHREY and my friend WILLIAM FIELD of THAKEHAM in the County aforesaid yeoman All those my copyhold or customary Estates and Estates of Inheritance situate lying and being in the several Parishes of WEST CHILTINGTON and PULBOROUGH in the said County called SPARROWS, now in my own occupation and the Dwelling house and Land called STURTS wherein I now dwell, both which estates are situated in and holden of the Manor of CHILTINGTON and my two Messuages on CHILTINGTON COMMON with one Croft or Close of Land thereunto belonging holden of the Manor of NYTIMBER, and my farm called part of JORDANS situated in PULBOROUGH and holden of the Manor of NUTBOURN, as well as all other my real and personal Estates and Effects with all and every their Premises and Appurtenances also all my Household Furniture Implements of Husbandry, Stock, Chattels, ready Monies, and Monies owing or due to me at the time of my decease Upon Trust to pay and discharge my just Debts and funeral and testamentary Expenses out of the same And upon further Trust to permit and suffer my loving wife MARY to continue in and upon and to have and enjoy my said real and personal Estate and Effects (or the remainder thereof) and every part thereof and the rents Issues Profits and Annual produce thereof, for and during the Term of her natural life, and from and after her decease, or in case my said wife shall marry again without the consent of my Executors hereafter named, in either case which shall first happen I give devise and bequeath all my aforesaid real and personal Estates and Effects or such thereof as shall be then remaining unto my two Sons WILLIAM and EDWARD to be equally divided between them share and share alike as near as can be either by Sale, Valuation or otherwise as my Executors shall see good and equitable To hold unto my said Sons their Heirs Executors Administrators and Assigns for ever according to the nature or Tenure thereof Subject nevertheless and charged and chargeable with the payment of Ten pounds of lawful money unto my Daughter CHARLOTTE the wife of JOHN AYLING, or to be equally divided between the children of my said Daughter, in case she shall not be then living And charged likewise with the payment of a like sum of Ten pounds unto LUCY the Daughter of my said Wife, now the Wife of JAMES MITCHELL or unto her Son HENRY MITCHELL in case she shall not be then living, both which legacies I will and direct to be paid within twelve Months next after the Marriage or decease of my said Wife, and I desire that my said son EDWARD shall do, transact and manage the Husbandry or farming business and affaires for my said Wife during her lifetime or until such her marriage as aforesaid and that my said son WILLIAM shall be permitted and allowed to live with and be maintained by my said Wife so long as she shall retain my said property provided he shall be so long unmarried and that he shall continue to work for her in the same manner as he is now doing for me and so as shall be satisfactory to my said Executors

And I do hereby make and appoint my said son EDWARD ADAMS OTHERWISE HUMPHREY and my friend WILLIAM FIELD Executors of this my last Will In Trust nevertheless and to and for the several intents and purposes herein before mentioned and contained, allowing them to retain unto themselves so much of my said personal estate as will reimburse them for their time, trouble and expenses in this their trust And I further will and direct that my said Executors shall not be accountable or responsible for any loss or damage which may happen to my said Estate, or any part thereof, by the failure of any Banker or Broker or otherwise not occasioned by their or either of their own wilful act, neglect or connivance, nor the one of the for the other of them, but each for his own Acts, receipts and Defaults only And I do hereby utterly revoke set aside and make void all former and other Wills by me heretofore made ratifying and confirming this and no other to be my last Will and Testament and which I do declare to be so In Witness whereof I the said SAMUEL ADAMS OTHERWISE HUMPHREY the Testator have here3unto set my Hand and affixed my Seal this Twenty fourth day of July in the year of our Lord one thousand eight hundred and twenty three – the Mark and Seal of X SAMUEL ADAMS OTHERWISE HUMPREY (LS) – Signed sealed published and declared by the said SAMUEL ADAMS OTHERWISE HUMPHREY the Testator as and for his last Will and Testament in the presence of us, who at his request and in his presence and in the presence of each other have subscribed our Names as witnesses – RICHD HERRINGTON WILLM HERRINGTON CHARLES LEWRY

This Will was proved before the Revd George Bliss Clerk A M Surrogate &c on the 26th day of November in the year of our Lord 1823, On the Path of EDWARD ADAMS OTHERWISE HUMPHREY one of the Executors named therein (Power being reserved for WILLIAM FIELD the other Executor named therein when &c) To whom a day was given for exhibiting a Inventory &c
