Will of James Durrant of Warningcamp

In the name of God Amen I James Durrant of Warningcamp in the County of Sussex yeom being sick in body but of sound & disposing mind memory & understanding revoking all former & other Wills by me made doe make publish & declare this my last Will & Testament in manner & forme following, that is to say. Imprimis I give & bequeath unto my loving wife one bed with the furniture thereunto belonging. Item I give & bequeath unto my said wife one pott one kittle & other necessarys for her use as my trustees herein after named shall think proper. Item my will & meaning is & I do hereby order and direct that all my stock & goods be sold as soon as may conveniently be & the moneys thereby arising to be putt out at interest for the bringing up of my children & in case the interest of my moneys shall not be thought sufficient to maintaine my said children then I do hereby give my trustees full power to enter upon the principal in order for the bringing of my said children. And what moneys shall be left after my said children are brought up I give & bequeath unto my two sons equally to be devided betweene them share & share alike. Item I do hereby order & direct that all my debts be paid and discharged. Item I doe hereby order that if either of my sons shall happen to be fined into a copyhold where my said wife and daughters lifes are in that my trustees do pay the said fine & discount the money that shall be paid for such fine with such son that shall be so fined in. Item I doe hereby make nominate and appoint my said wife executrix. And John Woollvin of Northstoke & Thomas Smart of Warningcamp & Richard Holmes of Arundell trustees of this my last Will & Testament. And doe hereby give my said trustees full power & authority to act & doe in the execution of this my Will as they shall think proper. In witness whereof I the said James Durrant have hereunto sett my hand & seal the two & twentith day of December in the third year of the raigne of our Soveraigne Lord George the Second King of Great Britaine &c Annoq Dni 1729. Signed sealed published & declared by the said James Durrant the testator to be his last Will & Testament in the p’sence of us who subscribed our names in the said testator’s p’sence the words ‘shall think proper wife’ being first interlined. Will: Bristow; John Emy his mark; Mary Waller? her mark
