Will of Jesse Attree of Cuckfield

This is the last Will and Testament of me Jesse Attree of Cuckfield in the County of Sussex Innkeeper I bequeath to my Wife Ann Attree such of my household goods plate linen china and other articles and effects usually in or about my dwellinghouse not exceeding in value the sum of Twenty Pounds as she shall make choice of and select within three calendar months after my decease I bequeath to my said Wife the sum of Twenty Pounds to be paid to her within the same period I bequeath all my personal estate except such part thereof as I have hereinbefore disposed of unto my Sons in law Benjamin Packham of Hurstpierpoint in the said County Miller and Spencer Weston of Brighton in the said County Grocer Upon trust that they or the survivor of them his executors or administrators shall as soon as conveniently may be call in sell and convert into money such part of my said personal estate as shall not consist of money and shall by and out of the monies thereby arising and the money of which I shall be possessed at my death pay my funeral and testamentary expences and debts and the Legacy herein before bequeathed and shall invest the residue of the said monies in the names or name of the said Benjamin Packham and Spencer Weston or the survivor of them his executors or administrators hereinafter called the Trustees or Trustee in any of the Public stocks or funds of Great Britain or upon Government or real Securities in England with power for the said Trustees or Trustee to vary the said stocks funds and securities at their or his discretion And I declare that the said Trustees or Trustee shall pay the annual income of the said trust funds to my said Wife so long as she shall continue my Widow and after her death or marriage shall hold the said stocks funds and securities Upon trust to divide the same into five equal parts or shares and to pay out of such parts or shares unto each of my daughters Harriett Weston Wife of the said Spencer Weston Caroline Packham wife of the said Benjamin Packham Emma Stenning wife of Walter Stenning of Brighton aforesaid Tailor and Ann Packham wife of Leonard Packham of Eastbourne in the said County Victualler and the remaining part or share unto my Grandson George Attree Son of my late daughter Mary Attree deceased And I do hereby declare that in case my said Grandson George Attree shall depart this life during the widowhood of my said Wife intestate without leaving any widow or child of him my said Grandson him surviving and without having legally assigned or disposed of his said share my said Trustees or Trustee shall stand possessed of the same share or of such part thereof as shall not have been legally assigned or disposed of Upon trust immediately after the death or marriage of my said Wife to divide and pay the same between and unto my said daughters Harriett Weston Caroline Packham Emma Stenning and Ann Packham in equal shares and proportions I appoint my said Sons in law Benjamin Packham and Spencer Weston Executors of this my Will and I direct my said Trustees and Executors to pay and allow to each other all costs and expences to be incurred in the execution of the trusts hereof And I declare that neither of them shall be answerable for the other of them nor for any involuntary loss which may happen to my trust estate In witness whereof I have hereunto set my hand the fifth day of March in the year of our Lord One thousand eight hundred and fifty three _ Jesse Attre
