Will of Walter Stanbridge of West Hoathly

This is the last will and testament of me Walter Stanbridge of West Hoathly in the county of Sussex yeoman made this tenth day of June in the year of our lord one thousand seven hundred and eighty in manner and fform following Whereas I have previous to the making hereof surrendered into the hands of the lord of the manor of Imberhorne in the county of Sussex all those three pieces or parcelse of copyhold or customary land holden of the said manor containing by estimation ten acres more or less parcel of land called Sainthill with the appurtenances paying yearly to the Lord seven pence halfpenny and which premises are situate lying and being in East Grinstead in the said county to the use of my last will and testament now in the pursuance thereof I do hereby give and depose all and singular the aforesaid copyhold or customary premises with their and every of their appurtenances unto my brother Thomas Stanbridge of Ardingly in the said county yeoman and John Comber of Stoneland in West Hoathly aforesaid yeoman and their heirs upon this special trust and confidence nevertheless that they that they the said Thomas Stanbridge and John Comber or the survivor of them and the heirs of such survivor do and shall as soon after my decease as possible sell all and singular the aforesaid customary premises for the best price that can be got and hereby direct that the monies arising by such sale shall be by them or their heirs Executors or administrators or the survivor of them -- heirs executors or administrators put and placed out upon the best securities that can be got for the same and I hereby will order and direct that the interest and produce there of arising shall from time to time as the same ----- due be paid by any said trustees without my dear and loving wife Mary during her widowhood and from and after her decease or marriage again which shall first happen I hereby order and direct my aforesaid trustees to pay and apply the monies arising by the aforesaid sale in manner here in after directed also I give and bequeath unto the said Thomas Stanbridge and John Comber all and singular my personal estate of what nature or kind soever or whensoever upon this special trust and confidence nevertheless that they permit and suffer my said wife Mary to carry forward the ffarming business which I now use for the term of her life or marriage again which shall first happen towards other maintenance and the maintenance Education and Bringing up my children and from and after her decease or Marriage again to pay and apply all singular my personal Estate and premises aforesaid in manner herein after directed that is to say I give and bequeath unto my sons Thomas Stanbridge Walter Stanbridge Henry Stanbridge and John Stanbridge the sum of two hundred pounds apiece of lawful money of Great Britain to be paid them by my executors hereinafter mentioned in manner and fform following that is to say one hundred pounds apiece apart part of their said legacies to be paid to each of them as shall have attained their age of twenty one years within six months next after my decease and one hundred pounds apiece to the others as they shall respectively attain their ages of twenty one years. They my aforesaid sons first giving proper security to my aforesaid Trustees to pay Interest for the same to my said wife after the Rate of ffour pounds for every hundred pounds for a year for and during the term of her natural life or marriage again which shall first happen and from and after her decease or marriage again I hereby will order and direct that my aforesaid Trustees shall and do pay the remainder or whole of the said legacies to my said sons within six months next after either of the said cases happening. Also I give and bequeath unto my daughters Mary Stanbridge Jane Stanbridge Susanna Stanbridge Elizabeth Stanbridge Ann Stanbridge Sarah Stanbridge Catherine Stanbridge and Hannah Stanbridge the sum of fifty pounds a piece of like lawful money to be paid them by my trustees and Executors as they shall severally attain their ages of twenty one years they and every one of them first giving good security to my said Trustees to pay to my aforesaid wife Mary in trust for the same after the rate of ffour pounds per cent per annum for and during the term of her natural life or marriage again which shall first happen and from and after her decease or marriage again which shall first happen I hereby give and bequeath unto each and every of my aforesaid daughters the ffurther sum of fifty pounds apiece of like lawful money to be paid them by my Executors and Trustees within six months next after death of my said wife or her marriage again and in case of her marriage again I give and bequeath to her the sum of two hundred pounds only to be paid her by my executors and trustees within six months next after such her marriage and as to the rest residue and remainder of my Goods chattels credits Ready monies and personal Estate of what nature or kind soever or whosoever after payment of my just debts Legacies and ffuneral Expenses I give and dispose thereof as followeth that is to say I give and bequeath one fourth part thereof unto my son Thomas Stanbridge and the remainder thereof I thereby give and bequeath unto the rest of my children sons and daughters equally to be divided amongst them share and share alike and I do hereby make constitute and appoint my said Brother Thomas Stanbridge and the aforesaid John Comber Executors of this my last will and testament and request they will take upon them the Burthen and execution thereof and my will is and I hereby declare that my said Executors and Trustees or either of them any or either of their heirs Executors or administrators shall not be charged with or accountable for more of the aforesaid estates or monies that they or either of them shall actually receive or shall come to their any or either of their hands by virtue of this my will nor with or for any loss which shall happen of the said monies and estates or any part there of so as such loss happen without their wilful default nor the one of them for the other of them or for the acts goods receipts defaults or disbursements the one or the other and also that it shall and may be lawful for the many said Executors and Trustees by and out of the premises to deduct and reimburse himself and themselves respectively all costs charges and Expenses which they or any or either of them may be put unto for or by reason of the performance of this my will or the trusts hereby in them reposed and lastly I hereby revoke and make void all former and other wills by me heretofore made and publish and declare this only to be my last will and testament being contained in two sheets of paper In witness thereof I have to the first sheet thereof set my hand and to this second sheet my hand and seal also the day and year first written Walter Stanbridge (sig.) and signed sealed published and declared by the said Walter Stanbridge the Testator as and for this last will and testament in the presence of us who have subscribed our names as witnesses in the presence and at the request of the said testator and in the presence of each other Ja. Whereas I Walter Stanbridge of West Hoathly in the county of Sussex yeoman have made my last will and testament in writing bearing date the tenth day of June which was in the year of our lord one thousand seven hundred and eighty and did thereby make constitute and appoint my brother Thomas Stanbridge of Ardingly in the said county yeoman and John Comber of Stoneland in West Hoathly aforesaid yeoman Executors and Trustees of my said will for the purposes therein mentioned and whereas my said brother since the making and executing my aforesaid will hath departed of this life I do hereby nominate constitute and appoint my respected friend John Comber of Batchelors in the parish of Balcomb in the said county joint Executor and Trustee of my said will together with the aforesaid John Comber of West Hoathly for the purposes therein mentioned and as relation being therein had may more fully and at large appear and that the said John Comber of Balcolm shall have the same power to act as my Executor and Trustee of my said will with the said John Comber of West Hoathly with room and place of the said Thomas Stanbridge deceased to all intents and purposes and I do hereby ratify and confirm my said will and all the Gifts devises Bequests matters and things therein contained and not hereby altered In witness whereof of the said Walter Stanbridge have herein set my hand and seal this twenty ninth day of december in the year of our lord one thousand seven hundred and Eighty one.
