Will of Samuel Braizer of Worth

This is the last Will and Testament of me Samuel Braizer of Worth Lodge in the parish of Worth in the County of Sussex Gentleman. I direct that all my just debts funeral and testamentary expences to be paid and satisfied with all convenient speed after my decease. And I give and bequeath all the rest residue and remainder of my personal estate and effects whatsoever and wheresoever and of what nature or kind unto my esteemed friends William Cutler of Ifield in the said County of Sussex Gentleman and Francis Waymark of the Shoe Sun Stores End Borough London their executors and administrators upon trust that they my said trustees or the survivor of them his executors or administrators shall and do as soon as conveniently may be after my decease sell and dispose of the saleable part thereof for the most money that can be reasonably gotten for the same either by public auction or private contract and shall and do call in and receive all such debts sum and sums of money as shall be due or owing to me at the time of my decease and do and shall stand possessed of the money to arise or be gotten in by the means aforesaid or otherwise under or by virtue of this my Will upon trust to place the same out at interest upon Government or other good and sufficient security or securities in their own names and to pay the interest dividends and proceeds thereof as the same shall become due & payable unto my beloved wife Elizabeth for and during the term of her natural; life and from and immediately after her decease or within twelve months after that event at latest upon trust to pay assign transfer and convey one full third or share of my said personal estate and effects unto my daughter Ann the wife of James Dench, one other full third part or share thereof unto my son Samuel Braizer and to pay the interest dividends and proceed of the remaining third part or share of my said personal estate and effects unto my daughter Sarah the wife of Thomas Dench for and during her natural life to and for her sole use & benefit. And I direct that her receipt alone shall be a good and sufficient discharge to my executors for the same notwithstanding her present or any future husband and not to be subject to his debts contracts controul or engagements and from and immediately after her decease I give and bequeath the said last mentioned third part or share of my said personal estate and effects unto and amongst all and every her children share and share alike. And I direct my said trustees to pay assign transfer and convey the same to them accordingly. And I do hereby direct that in case any or either of my said legatees shall happen to die before his her or their part or share or parts or shares shall become due and payable leaving issue of his her and their body or bodies lawfully begotten that the part or share or parts or shares of him her or them so dying shall be paid to and equally divided between his her or their issue share and share alike if more than one and if but one then to such only child when and as they shall severally attain the age of twenty one years with the accumulations of interest in the meantime. And I do hereby nominate constitute and appoint the said William Cutler and Francis Waymark joint executors and trustees of this my Will. And I direct that they shall be paid their reasonable expences and for time & trouble executing the same. And I revoke all former Wills by me made and do declare this to be my last Will and Testament. In witness whereof I the said Samuel Braizer the testator have to this my last Will and Testament contained in two sheets of paper to the first sheet thereof set my hand and to this second and last sheet thereof set my hand and seal this twenty ninth day of April one thousand eight hundred and thirty one. Signed sealed published and declared by the said Samuel Braizer the testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses. This to be taken as a Codicil to my last Will and Testament. I hereby revoke the appointment of William Cutler and Francis Waymark as my executors and trustees and do appoint in their stead Richard Turner of West Hoathly, Sussex farmer and James Creasey of Buckwood, Sussex farmer to be my executors and trustees under my said Will instead of the said William Cutler and Francis Waymark. Proved at London with a Codicil 18th March 1835 before the Worshipful John Daubeny, Doctor of Laws and Surrogate by the oath of Richard Turner one of the executors named in the said Codicil to whom administration was granted having been first sworn duly to administer, power reserved of making the like grant to James Creasey the other executor named in the said Codicil when he shall apply for the same.
