The Will of Josiah Povey Rector of Telscombe 31st March 1727 (Canterbury will)

In the name of god Amen

I Josiah Povey Rector of Telscombe in the county of Sussex being weak and infirm in body but sound and perfect mind memory and understanding god almighty be praised therefore do make and ordain publish and declare this my last will and testament in writing in manner and form following

First and principally I commit my soul into the hands of almighty god my creator hoping for salvation thro the merits of Jesus Christ my blessed saviour and redeemer and my body I commit to the earth to be privately buried in the church of the parish church of Telscombe aforesaid to be carried only by four bearers without attendants and as touching the disposition of such

Worldly estate with which it hath pleased god to bless me with I do hereby will give and dispose thereof as followeth and first I give and bequeath to every poor person of my parish of Telscombe aforesaid one shilling to be paid then by my executor the next after my funeral

Also I give and devise all that my messuage barn lands and premises late Taylors situate lying and being at St John Common in the parish _____ and now in the occupation of ___ Belchamber or his assigns unto my loving wife Dorothy Povey and my brother in law Cornelius Humphrey and his heirs in trust that they and the survivor of them and his or her heirs do and shall after all repaying repairs thereof done pay yearly his rents and profits thereof to a fit person to teach children to read write and sew within the parish of Telscombe aforesaid and my will and meaning is that the minister of Telscombe for the time being or the vicar of Piddinghoe shall not teach any of the said children or be intitled to any of the rents or profits of the said rents given as aforesaid unto my said wife and to the said Cornelius Humphrey and their heirs in order for the schoolhouse for the children to be taught is as aforesaid. And I deivse my friend Richard Rufsell Doctor of Physick to appoint and approve of such person to teach school as aforesaid.

Also I give and bequeath unto my brother Charles Povey the sume of one hundred pounds of lawful British money to be paid unto him by my executor hereafter named within six months here after my decease

Also I give and bequeath unto my cousin Josiah Wilkinson and to Mrs Elizabeth Jones and to each of them the sume of ten shillings to be paid them monthly from and after my decease during the terms of their natural lives and the life of the longest liver of them out of the rents of all these my farms lands and premises lying in the several parishes of Plumpton and Henfield in the county of Sussex

Also I give and devise all those messuages or tenements lands and premises whatsoever situate lying and bring in Southease in the county aforesaid unto my wife Dorothy Povey and her heirs forever

Also I give and devise all that my messuage or tenement and garden late Paynes lying in Telscombe aforesaid unto my wife and her heirs on condition she does not attain time marry after my decease but if she shall happen to marry then I give her the said messuage and garden during her life only

Also I give and devise all that the messuage and tenement in which I dwell with the backside and garden thereunto belonging lying in Telscombe aforesaid into my loving wife Dorothy Povey and her heirs forever

Also I give and devise all those lands tenements and premises late Bowleys lying in Plumpton aforesaid and also all those my lands called Newfields in Henfield aforesaid charged with the annuity as aforesaid and also all that my messuages barns lands and premises late Butchers lying at St John’s Common in the parish of ___ aforesaid unto my loving wife Dotothy Povey and her assigns for and during the term of her natural life in case she shall so long continue a widow and from and after her messuage or decease which shall first happen

I give and devise all those my aforesaid messuage barn land premises situate lying and being in Plumpton and Henfield aforesaid and my barns and lands late Butshaw lying at St John’s Common aforesaid unto the present Lord Bishop of Chichester and to his successors the Bishops of Chichester forever desiring them to be my trustees and to cause the rents and profits of my said estates to be paid annually to the poor debtors in the goals of Stafford in Staffordshire and Horsham in Sussex forever

Also I give and bequeath unto my said wife the retention of a church life of forty pounds and in Lombard Street London

Also I give and bequeath unto my said wife the arrears of rents being two hundred pounds due to me from Fitzgerald out of the lands in Kilmond in Ireland

Also I give and bequeath unto my said loving wife all my goods chattels and personnel estate of whatever kind or sort server (my just debts legacies and funeral expenses being first paid and discharges ) whom I do hereby make ordain and appoint full and sole executor of this my will and I do hereby revoke and declare void all former other wills or wills by me att any time or times had made or published

In witness whereof I have to this my last will and testament as contained in two sheets of paper to each sheet sett my hand and seal the one and thirtieth day of March in the 13th year of his presence majesty King George anno domi 1727

Jo Povey signed sealed published and declared by the said Josiah Povey the testator as and for his last will and testament in the presence of us who in the presence of him here unto subscribed our names as witness thereof
