Will of John Capon of Rusper

Date signed: 07 Mar 1789, Probate date: 02 Nov 1796

This is the last Will and Testament of me John Capon of the Parish of Rusper in the County of Sussex ffarmer Imprimis I direct that all my just Debts and ffuneral Expences and Probate of this my Will be in the first place paid and satisfied Also I give and bequeath to my Son William Capon the Sum of One hundred Pounds of lawful Money of Great Britain to be paid to him immediately after my decease Also I give and bequeath to my said Son William the Leases of all ffarms and Lands I now Occupy he my said Son William Paying According to a ffair Valuation to my Residuary Legatee hereinafter named for every thing in or upon my said ffarm and Lands Also I give and bequeath to my Son in Law Henry Botting the Sum of ffive Pounds of lawful Money of Great Britain to be paid to him within One Month next after my decease Also I give and bequeath to Thomas Illman my Apprentice bound to me by the Parish of Rusper aforesaid the Sum of Ten Pounds of like lawful Money to be Paid to him at his Age of twenty four Years but in case he should not live to attain such Age then I direct that the said Sum of Ten Pounds so given to him shall lapse into the Residue of my Personal Estate Also I give and bequeath to my Son John Capon all my Bonds Bills Mortgages Ready Money and Personal Estate of what kind or nature soever not herein and hereby otherwise disposed of after Payment of my just Debts the aforesaid Legacies and ffuneral Expences And also all the Costs Charges and Expences whatsoever in carrying this my Will into Execution In Trust out of the Interest and Profits of my said Personal Estate ro Pay to my loving Wife Mary One Annuity or Yearly Sum of Twelve Pounds of lawful Money of Great Britain by four Quarterly Payments for and during the term of her natural life the first Payment thereof to begin And be made at the end of three Calendar Months next after my decease and from and after the decease of my said Wife The In Trust to Pay and divide the Residue of my Personal Estate unto between and amongst all my Children namely himself my said Son John and my other Sons Daniel and William and my Daughters Jane Elizabeth and Ann equally share and share alike within One Month next after the decease of her my said Wife And in case any or either of my said Children should happen to die in the life time Of my said Wife Then in Trust to Pay the Part or share Of him her or them so dying to his her or their Personal Representative or Representatives Also whereas the Legacy above given to my said Son William will not be Money sufficient for him to go on with the Business of the said ffarms I now Occupy (the Leases whereof I have given to him as aforesaid) without borrowing a Considerable Sum of Money Now in case my said Son John shall (after the Stock and every thing in and upon my said ffarm and Lands have been valued) think Proper to Trust him my said Son William with the same upon his given such Security as my said Son John shall approve of for Payment of such Sum of Money as the same shall be valued at with Interest at the rate of ffour Pounds P Centum P Annum he my said Son John shall not be Accountable to the Rest of my said Children for any Loss or Losses that shall or may be Occasioned thereby it being my Will and meaning that my said Son William should have my Stock and every thing in or Upon my said ffarms for the more Advantageous carrying On his Business Provided he gives Security for the Payment of such Money as the same shall be valued at as aforesaid with Interest as aforesaid Yet that my said son John may call in such Money if my said Son William shall go on in an improper manner in the Opinion of my said Son John likely to waste his Substance And I do hereby nominate constitute and appoint them my said Sons John and William Joint Executors of this my last Will and Testament In Witness whereof I the said John Capon the Testator have to this my last Will and Testament contained in two Sheets of Paper to each Sheet thereof set my Hand and Seal the seventh Day of March in the Year of our Lord one thousand seven hundred and eighty nine John Capon
