Will of John Dugatt of Rye

In the name of God Amen the twelveth daie of September in the first yeare of his Maisties Raigne Charles by the grace of God Kinge of England Scotlande France and Ireland defender of the faith &c and in the yeare of our Lord God one thowsand sixe hundred twentie and five I John Dugatt of the anncient towne of Rye in the Countie of Sussex mariner beinge sicke in bodie but of whole mynde and in good and perfect remembrance laude and praise be to Allmightie God doe make and ordaine this my present and laste Will in manner and forme followinge. That is to saie. First I comende my soule unto Allmightie God my maker and redeemer and my bodie to be buried in the parishe church or churchyarde of Rye aforesaide. Item I will that all such debts and duties as I owe of right or of conscience to anie person or persons to be well and trulie contented and paide by my executor hereafter named and ordained for to be paide without anie delaie or contradicon and after my debts beinge payde and my funerall expences performed I will that all my goodes chattells and debts due unto me shalbe bequeathed and given in manner and forme as followeth. Item I give unto the poore of Rye five poundes of English money. First I give and bequeath unto my kinsman John Dugatt the sonne of my brother Emanuell Dugatt deceased my dwellinge house in Rye with the appurtenances when he shall attaine to the age of fowerteene yeares, and in the meane time my sister Sarah Sarkey widdowe shall dwell in it rent free provided that she keeps it in sufficient reparacon then my meaninge is that if the aforesaide John Dugatt shall dye without anie heires of his bodie lawfully begotten that then it shall come to Joseph Dugatt beinge another of my brother Emanuells sonnes and to the heires of his bodie lawfullie begotten. And if he dye without anie heires of his bodie lawfullie begotten, then to my sister Sarah Starkey and to her heires lawfullie begotten. And if that my sister Sarah Starkey die without heires of her bodie lawfullie begotten, then to goe to Marye Chanler the daughter of my sister Elizabeth Dougatt and to the heires of her bodie lawfullie begotten. And if she dye without heirs of her bodie lawfully begotten then to the two children of my brother Joseph Michaell, John Michaell and Anne Michaell. Item I give and bequeath unto John Dugatt my kinsman the sume of three score poundes of lawfull money of England when he shall attaine to the age of sixteene yeares to be paide by my executor. Item I give and bequeath unto my kinsman Joseph Dugatt fortie poundes of currant English money when he cometh unto the age of sixteene yeares to be paide by my executor. Item I give and bequeath unto my sister Sarah Starkey widdowe fortie poundes of currant Englishe money by my executor. Item I give unto my kinswoman Margerye Smith my sister Sarahs daughter twentie pounds of currant Englishe money by my executor. Item I give and bequeath unto Marie Chanler my sister Elizabeths daughter twentie poundes of currant English money when she cometh to the age of eighteene yeares to be paide by my executor. Item I give and bequeath unto my brother Joseph Michaells two children John Michaell and Anne Michaell twentie poundes a peece of currant English money to be paide when they shall attaine to the ages of eighteene yeares to be paide by my executor. Item I give and bequeath unto Margarett Dugatt wyddowe my sister in lawe twentie poundes of currant English money to be paide by my executor. Item I give and bequeath unto Margerie Michaell my sister in lawe tenne poundes of currant English money to be paide by my executor. Item I give and bequeath unto Margarett Bowyer my sister by the mother twentie shillings of currant English money to be paide by my executor. Item I give and bequeath the thirds of my Barke called The Guifte of God unto my two kinsmen John Dugatt and Joseph Dugatt. Item I give and bequeath unto my kinsmen John Dugatt and Joseph Dugatt and my sister Sarah Starkey all my netts and houshould stuffe equallie to be devided amongst them. Item I give and bequeath unto Griffith Reignolds our Minister fortie shillings of currant English money to be paide by my executor. I desire him if possible it maie be that he will preache for me at my funerall. Lastlie all the rest of my goodes chattells unbequeathed I give and bequeath unto Master Richard Mills one of the Juratts of our towne of Rye whom I make my sole and onelie executor of this my last Will and testament unrevocable. In wittnes hereof I have put to my hand and seale the daie and yeare above written. Memorandum the ensealinge hereof it is my will and meaninge that if John Dugatt and Joseph Dugatt shall dye before they come to the age of sixteene yeares that then the porcons of money bequeathed unto them shall goe amongst the rest of my brother and sisters children Margerie Smith, Marie Chanler, John Michaell and Anne Michaell equallie to be devided amongst the survivor or survivors of them. John Dugatts marke and seale of his last Will and Testament. Thes beinge wittnesses Griffithe Reignolds, Clerk; Thomas Dixons marke, Robert Mills.

Proved at London before William Sams, Doctor of Laws, Surrogate to the Ven Henry Marten, Doctor of Laws, Keeper of the Prerogative Court of Canterbury 1st February 1625 by Richard Mills the executor named in the said Will to whom administration of the goods & credits of the deceased was granted
