Will of Robert Bishop of Rye

This is the last Will and Testament of me Robert Bishop of the Parish of Rye Sussex Yeoman First I direct that all my just debts and funeral and testamentary charges be fully paid and satisfied I give and bequeath unto my dear wife Mercy Bishop her clothes and wearing apparel of all worth and I give to my said wife the use and enjoyment and reasonable wear and tear of all my household goods and furniture and implements of household in and about my house at the time of my decease for and during the term of her natural life and from and after her decease I direct the same shall be sold by my executor hereinafter named and the produce thereof considered as part of the residue of my estate and I direct that an Inventory be made of the said household and furniture so soon as conveniently may be after my decease I give to my said wife all my liquors provisions and food in and about my house at the time of my decease absolutely to her own use I give devise and bequeath all and every my messuages lands tenements and hereditaments and parts and shared parts and shares of messuages lands tenements and hereditaments and real estate whatsoever and wheresoever of which I shall die seized or possessed unto Thomas Phillipps Lamb of Mountfield in the Parish Of Rye aforesaid Esquire his heirs and assigns upon trust to sell and dispose thereof at such time or times as he or they shall think proper and either by public sale or private contract and together or in parcels and for such price or prices as can be reasonably had or gotten for the same and upon payment of the purchase or purchases therof and his heir and their heirs and assigns and for the facilitating such sale or sales I direct that the receipt or receipts of the said Thomas Phillipps Lamb and his heirs shall be good and sufficient discharge or good and sufficient discharges for so much and such part of the purchase money for which the said hereditaments or any part thereof shall be sold as aforesaid as in such receipt or receipts be acknowledged or expressed to be received and that such purchaser or purchasers of the said hereditaments or any part thereof his her or their executors or administrators shall not afterwards be obliged to see to the application thereof or of any part thereof or be answerable or accountable for the application or non application thereof or in any part thereof And I do hereby will and direct that the money which shall aries or be produced by or from the sale or sales herein before directed shall be considered as and to constitute part of the residue of my estate I give and bequeath unto my son Robert Bishop the sum of twelve guineas and as to the residue and remainder of my estate and effects whatsoever and wheresoever not herein before by me otherwise disposed of and which shall remain after payment of all my just debts and funeral expenses and the legacies herein before given I give and bequeath the same unto the said Thomas Phillipps Lamb his executors and administrators Upon the several trusts and to and for the several interests and purposes herein after expressed and declared of and concerning the same (that is to say) Upon trust to sell and dispose of such part or parts thereof as shall not consist of monies or securities for money at such time or times and in such manner as the said Thomas Phillipps Lamb his executors or administrators shall think proper and to collect and get in my debts and upon further trust that he the said Thomas Phillips Lamb his executors or administrators do and shall forthwith lay and invest the monies to arise or be received from the residue of my estate and also the sum or sums of money which shall arise or be produced by or from the sale of my said real estate (herein before directed to constitute part of the residue of my estate) as the same shall be got in and received in some or one of the Public Stocks or Funds or upon Real Securities at Interest in his or their name or names with full power and authority for him the said Thomas Phillips Lamb his executors and administrators to vary from time to time for others of the same or the like nature as he or they shall think proper and do and shall stand possessed of the Stocks Funds and Securities in or upon which the same shall be laid out or invested upon the trusts following (that is to say) Upon trust to pay and apply the dividends interest and annual produce thereof from time to time as the same shall become due unto my dear wife Mercy Bishop or her assigns or permit her and them to receive and take the same to and for her and their own use and benefit for and during the term of her natural life and from and after her decease Upon trust to transfer assign and make over the said stocks funds and securities in and upon which the said residue of my estate shall be then placed out or invested unto my sons and daughters Robert Bishop Richard Bishop John Bishop Mercy Bishop Hannah Bishop equally to be divided between them share and share alike and to their several and respective executors administrators and assigns absolutely and forever And I hereby constitute and appoint the said Thomas Phillips Lamb executor of this my Will and I do hereby will and direct that the said Thomas Phillips Lamb his heirs executors or administrators shall not be answerable or accountable for any more of my estate and effects than shall actually come to his or their hands and possession nor for the insufficiency or deficiency of nay security or securities in or upon which any part of my estate shall be laid out or invested pursuant to the trusts aforesaid nor for any loss that shall happen to the same so that such loss happen without his or their willful neglect And I do hereby further will and direct that it shall be lawful for the said Thomas Phillipps Lamb his heirs executors or administrators by and out of any part of my estate that shall come to his or their hands or the income or produce thereof to deduct and reimburse himself and themselves all charges and expenses which he or they shall pay or be put to in or about the execution of all or any part of the trusts hereby in him repose as aforesaid or any act matter or thing relating thereto And lastly I hereby revoke all former and other wills by me at any time heretofore made and declare these presents only contained in two sheets of paper to be my last will and testament In witness thereof I the said Robert Bishop the testator have to the first sheet therof set my hand only and to this second and last sheet set my hand and seal On the 8th day of March 1800 was sworn Thomas Phillips Lamb Esq sole executor in this will named to whom was committed the administration of the goods chattels etc in the burden of the execution of the execution of the same by us D Hollingsbury Cary

Value of Goods Chattels sworn to be above 20£ and under 100£.

NOTE 1: The will was transcribed from a microfilm copy of the original will held at East Sussex Records Office by Bob Trease on 12 May 2006.

NOTE 2: The executor Thomas Phillips Lamb was son of Thomas Lamb of Lamb House Rye and was a prominent citizen of Rye having served as Lord Mayor and Deputy Mayor. He was also appointed executor of his father’s will when Thomas Lamb died in 1803. Thomas Phillips Lamb himself died in 1818.
