Will of Thomas Sheerman of Brighton

This is the last Will of me Thomas Sheerman at present residing at No. 179 Western Road in the parish of Brighton in the county of Sussex Appraiser I give and bequeath to my wife Jane her heirs executors administrators and assigns All the household furniture linen china glass and effects that may be in or upon the house and premises in which I may reside at the time of my decease to and for her own sole use and benefit I also give and bequeath to my said wife Jane the household furniture and effects that may be upon the premises situate and being No 15 in Bedford Square Brighton (as now let as a furniture house) she paying or causing to be paid to the landlord of the said house the yearly rent of fifty two pounds ten shillings (being that portion of the rent for which I hold the two houses No 14 & 15 Bedford Square) and to be subject to the contributions contained in a lease granted to me by Mr. Borne Esqre also to pay all rates taxes and assessments whatsoever that may be charged upon the said premises I give and bequeath to my daughter Emily Sheerman In trust the whole of the household furniture & effects in and upon the house & premises No 14 in Bedford Square also the lease of the said house (which I hold jointly with No 15 in the same square) upon her paying or causing to be paid that portion of the rent amounting to fifty two pounds ten shillings per annum together with all rates and taxes that are or may be chargeable upon the said house & premises I give and bequeath to my daughter Mary her heirs executors administrators and assigns the lease of the house No 147 Kings Road in the parish of Brighton now occupied by Mrs Masterman together with the fixtures therein subject nevertheless to the payment of the rent to the superior landlord I also give and bequeath to my said daughter Mary the sum of two hundred pounds or any part of such sum as may be due to me at the time of my decease from the said E. Masterman together with any interest that may be due thereon I give and bequeath to my daughter Sarah now Mrs Collins for her own sole use and benefit and not subject to the controul of her husband the freehold property situate at Preston in the county of Sussex as now let on lease to Mr Stanmer for her life and at her death to be sold and the proceeds of such sale to be equally divided between her children (lawfully begotten) then living but should she have no children then living then to my next heir (the said freehold premises being let on lease to Mr Stanmer with a purchasing clause of £400 should they purchase the said lease I direct my Executors & Trustees to invest the money either on mortgages on freehold copyhold or long leasehold property of ample value or in any of the English funds and to pay over to my said daughter Sarah the interest payable upon the said sum of £400 I give and bequeath to my son Richard John his heirs executors administrators and assigns my leasehold property at Hackney in the county of Middlesex subject nevertheless to the payment of the rent to the superior landlord I give and bequeath to my son George his heirs executors administrators and assigns my freehold property situate in Steyne Gardens in the parish of Brighton also my leasehold property situate in Pimlico in the parish of Brighton also my leasehold property situate at Providence Place in the said parish of Brighton subject nevertheless to the rent payable to the superior landlord in respect to the latter I give and bequeath to my son Thomas William his heirs executors administrators and assigns all the Residue of my estates whether freehold leasehold or copyhold subject nevertheless to the payment of all rents due to the superior landlord or landlords (except the freehold house situate in Norfolk Road late Chalybeate St in the parish of Brighton And I hereby appoint my son Thomas William and Mr Samuel Akehurst of Brighton to be my Trustees and Executors to my freehold houses in Norfolk Road I request my Executors and Trustees to sell by public auction or private contract also to collect all debts that may be due to me either upon bonds mortgage book debts stock in trade goods or hire balance in my Bankers hands bills of exchange securities and moneys and after payment of all my just debts mortgage or mortgages testamentary and funeral expenses together with twenty five pounds to Mr Samuel Akehurst as a mark of my esteem and respect the residue to be paid over to my wife Jane and all my children then living share and share alike Hereby revoking all former Wills & declare this to contain my last Will and Testament In witness hereof I the said testator have hereto set my hand and seal this twenty first day of July one thousand eight hundred and forty five – Thomas Sheerman
