Will of Thomas Durrant of Heathfield

In the name of God Amen I Thomas Durrant of Heathfield in the County of Sussex yeoman being sick and weal in body but of sound and perfect memory understanding thanks be to God for the same and calling to mind the certainty of my death and uncertainty of the time when it will happen do make and ordain this my last Will and Testament in manner and form following (that is to say) First and principally I comend my soul into the hands of Allmighty God my creator and redeemer trusting through the merritts and mediation of Jesus Christ my blessed saviour to have full pardon and forgiveness of all my sins and my body I commit to the earth to be decently inter’d at the discretion of my executor hereafter named. And as touching my worldly estate the God hath been pleased to bestow on me I give and bestow the same in form as followeth. Whereass I have surrendered into the hands of the Lord of the Manor of Saperton all that my copyhold messuage or tennement barn buildings and several piecess or parcells of land thereto belonging with the appurtenancess thereof belonging in Heathfield aforesaid holden of the said Manor of Sapperton to the use of my will. Now I do hereby give and devise the same to my son Edward Durrant of Heathfield in the County of Sussex husbandman his heirs executors and assigns for ever in trust nevertheless and to and for the usess intents and purposes hereafter mentioned (that is to say) In trust that the said premisses shall be and stand chargeable with the payment of one annuity or yearly rent charge of six pounds pr ann clear of all taxess unto my loving wife Ann and her assigns for and during the term of her natural life to be paid unto her quarterly the first payment to begin and be made on the first usall feast day for payments of rents next after my decease and the overplus of the rents or income of the said premisses after the said annuity of six pounds pr ann and taxess and repairs outset I order and appoint shall be equally divided between my three sons William Durrant, Joseph Durrant and the said Edward Durrant share and share alike. And also in further trust that my said son Edward Durrant or his heirs shall after my said wife Ann’s decease within the term of six months cause the said premisses to be vallued by three men whom I shall appoint viz Thomas Roads, Samuell Drawbridge and William Sands (if all three then living) or any two of them to value the said premisses to the true vallue acording to the best of there knowledge and the money which the three men shall vallue it worth shall be distributed as follows that is to say to my son John Durrant of Easthoadly farrier and his two children Robert and Sarah the sum of twenty pounds that is to say to my son John Durrant the sum of twelve pounds and to his two children Robert and Sarah the sum of four pounds each if they are the living if they are not living then the said sum of their part or either of them I give to my said son John Durrant and the remainder of the said sume of the valluation to be divided into three parts one third part to be paid to my son William wanting twenty pounds and that remainder of the valluation to be divided into two parts one half to be paid to my son Joseph Durrant and the other part to my son Edward Durrant my executor. And that my said son Edward Durrant his heirs executors or assigns shall pay the sums aforesaid in twelve months after the decease of my said wife Ann. Item I give and bequeath unto my said wife the use of the bed and furniture thereto belonging which was hers before I married her for the term of her life. And also the use of four pair of the best sheets for her life she giving my executor security that the same shall be returned in as good plight and manner as she had them allowing for ware and necessary use. Item I give to my said son Edward Durrant all the rest of my houshold goods wearing apparell ready money stock cattell and chattells whatsoever that I shall die possessed of and that my said son Edward Durrant shall pay my debts and funeral expencess which sum shall be equally taken out of the three parts and and my two sons William Durrant and Joseph Durrant shall alow him their equall parts in the said expencess and debts. And whereas upon my intermarriage with my said wife Ann I did give her a Bond for ninety three pounds now I do hereby order and apoint that in case my said wife should insist on the said ninety three pounds or any part thereof or refuse to cancell and give up the Bond to my executor hereafter named within three months after my decease that then the said annuity or yearly rent charge herein before given and any other legacy given to her shall be void and that she shall have no benefit for the same but that the said premisses shall be vallued as aforesaid by the said three men and shall be equally divided as before directed. Item I do hereby constitute ordain and appoint my said son Edward Durrant sole executor of this my will hereby revoking and making void all former Wills by me made at any time before. In witness whereof I have to this my last will containing in two sheets of paper set my hand and seal to each sheet this eighth day of February in the year of our Lord one thousand seaven hundred thirty and four. Signed sealed published and declared by the said Thomas Durrant the testator to be his last Will and Testament in the presence of us who have subscribed our names as witnessess in the presence of the said testator. William Sands, Jno Hassell, the mark of Robt Hassell.

The Will of Thomas Durrant late of Heathfield deced was proved the sixteenth day of July in the year of our Lord one thousand seven hundred and thirty five before the Reverend Mr George Jordan, Master of Arts and Commissary upon the oath of Edward Durrant only executor in the said Will named to whom was committed the admon of the goods and so forth being first sworn well and faithfully to administer the same an so forth.
