Will of William Durrant of Ringmer

I William Durrant of Ringmer in the County of Sussex yeoman do make publish and declare this my last Will and Testament hereby revoking all former and other Wills that I have made. First I commit my body to the earth thereunto be decently interred at the discretion of my executors hereinafter named and after payment of my just debts and funeral expences together with the charges of proving this my Will I give and devise unto my sons William Payne of Lagsheath in the County aforesaid Gentleman and Thomas Durrant of Meestham* in the County of Surry miller all my freehold and copyhold messuages malthouse lands tenements and hereditaments whatsoever lying and being in Ringmere* aforesaid having surrendered the copyhold lands and tenements to the use of my Will to hold the same unto the said William Payne and Thomas Durrant and their heirs untill my youngest child then living shall attain to the age of eighteen years upon trust nevertheless and to the intent and purpose that they the said William Payne and Thomas Durrant or the survivor of them or the heirs of such survivor do and shall out of the rents issues and profits thereof or thereby arising bring up and educate my youngest children untill they and every of them shall have respectively attained to the aforesaid age of eighteen years. And the surplus thereof to put and place out at interest on Government or other real security or securities and that they the said William Payne and Thomas Durrant or the survivor of them or the heirs of such survivor shall with all convenient speed after my youngest child shall have attained to the aforesaid age of eighteen years bargain and sell all and singular the premisses aforesaid with their and every of their appurtenances to the best advantage they can. And the money arising by such sale shall be equally divided between my children share and share alike. And in case any of my said children should depart this life before the youngest shall attain that age then the part or share of such child or children so dieing to be equally divided between his her or their child or children if any and if none to be equally divided between my children that shall be then living. Also I give and bequeath unto the said William Payne and Thomas Durrant all my goods chattells effects and personal estate whatsoever upon trust nevertheless to sell and dispose thereof to the best advantage they can and the money arising by such sale to put and place out at interest on Government or other real security or securities until my youngest child then living shall have attained to the age of eighteen years then the same together with the interest thereof to be equally divided between my children. And in case any of my children should depart this life before the youngest shall attain to that age then the part and share of such child or children so dieing to be equally divided between his her or their child or children if any. And if none to be equally divided between my children that shall be then living. But my will and mind further is that the part or share of my daughter Susanna now the wife of Richard Dicker shall remain and continue in the hands of my said trustees upon this special trust and confidence that they the said trustees or the survivor of them or the executors or administrators of such survivor do and shall well and truly pay or cause to be paid unto the said Richard Dicker the interest and dividends thereof for and during the natural life of his said wife Susanna. And I do hereby authorize and impower my said trustees and the survivor of them and the executor and admors of such survivor at any time or times to give the said Richard Dicker all the part or share of his said wife Susanna or such part thereof as they shall think he deserves. But in case my said trustees shall not have given the said Richard Dicker all or any part of his wifes share as aforesaid in her life I hereby order and direct my said trustees immediately after her decease to divide the said share or such part thereof as they shall not have given to the said Richard Dicker in the life time of his said wife equally amongst all their children if any and if none equally amongst all my children that shall be then living. And I do hereby direct and order that my said trustees or either of them shall not accountable or answerable for the loss of any monies which they or either of them shall put out at interest upon such security or securities as aforesaid unless the same shall be by his or their willfull neglect or default. And it shall and may be lawfull to and for my said trustees to retain and keep in their hands out of the said trust money all such necessary costs and charges which they shall bear pay sustain or be put unto upon account of the trust hereby reposed in them. And lastly I do hereby make nominate constitute and appoint the said William Payne and Thomas Durrant joint executors of this my Will. In witness whereof I the said William Durrant to this my last Will and Testament contained in three sheets of paper set my hand and seal (that is to say) to the two first sheets my hand and to this third sheet my hand and seal this third day of August in the year of our Lord one thousand seven hundred and seventy nine. Signed sealed published and declared by the said William Durrant the testator as and for his last Will and Testament in the presence of us who have subscribed our names as witnesses thereto at the request and in the presence of the said testator and of each other. The Will of William Durrant late of Ringer* within the Archdeaconry of Lewes yeoman deceased was proved the twenty fourth day of August in the year of our Lord one thousand seven hundred and eighty one before the Reverend Peter Guerin Crofts, Clerk, Surrogate and so forth upon the oath of William Payne and Thomas Durrant the joint executors in the said Will named to whom was committed the administration of the goods &c they being first sworn well and faithfully to administer the same and so forth.
