Will of William Durrant of Ringmer

This is the last Will and Testament of me William Durrant of Norlington in the parish of Ringmer in the County of Sussex carpenter made the first day of April one thousand eight hundred and sixty five. I give (subject to the payment of all my just debts and funeral and testamentary expenses) all the residue and remainder of my moneys and debts due and owing to me at the time of my decease to my dear wife Charlotte Durrant for her own absolute use and benefit. I appoint Frederick Martin of Ringmer aforesaid grocer and Charles Pockney of the same place shoemaker executors and also trustees of this my Will for the purposes hereinafter mentioned. I give all the household furniture and effects of every description which shall be in and about my dwelling house immediately previous to my decease to my said trustees upon trust to permit my said wife to have the personal use and enjoyment thereof for her life and after her decease upon trust to sell and convert the same into money and to stand possessed of the same upon the trusts hereinafter declared. I give and devise all my real estate (excepting copyhold) unto the said Frederick Martin and Charles Pockney their heirs and assigns upon trust to permit and suffer my said wife to occupy and use set receive and take the rents and profits thereof and paying thereout all costs for repairs insurance and interest of any mortgages during the term of her natural life she nevertheless maintaining and educating my several children during their respective minorities. And after the decease of my said wife upon trust that they my said trustees or trustee shall and do as soon as conveniently may be thereafter sell and dispose of my said real estates by public auction or private contract and in one or several lots and pay the divide the net proceeds thence arising (after defraying the expenses incident to such sale or sales) as hereinafter particularly mentioned and declared. I give and devise all my copyhold lands messuages tenements and hereditaments unto the said Frederick Martin his heirs assigns upon trust to permit my said wife to occupy or use or to receive and take the rents and assigns upon trust to permit my said wife to occupy or use or to receive and take the rents and profits thereof respectively and paying thereout all costs for repairs insurance and interest of of any mortgages during the term of her natural life subject to my said wife maintaining and educating my children as aforesaid. And after her decease upon trust to sell and dispose of the said copyhold hereditaments in the same manner as hereinbefore mentioned with respect to my said real estate and to pay and divide the net proceeds thence arising (after defraying the expenses incident to such sale or sales) as hereinafter particularly mentioned and declared provided nevertheless and I hereby direct and declare that the said Frederick Martin and Charles Pockney and the said Frederick Martin his heirs and assigns respectively or other the trustees or trustee of this my Will shall and do stand respectively possessed of the said several moneys arising from the respective sales and disposition of my said real estate copyhold hereditaments and household furniture and effects in trust for all my children in equal shares and the issue then living of either of my said children (being daughters who should have died in the lifetime of my said wife yet so distributively that the same shall participate only as representing their deceased parents provided that in case either of my said daughters shall have died in the lifetime of my said with without leaving issue but leaving a husband her respectively surviving then I direct that the share of each daughter shall be paid to her husband respectively provided always and I hereby declare that notwithstanding any of the trusts hereby declared it shall be lawful for my said trustees or trustee respectively at any time at the request in writing of my said wife to raise by mortgage (either with or without power of sale) of my said copyhold hereditaments any sum or sums of money as may be required for paying any fine and fees necessary on the admission of the said trustee to the same copyhold hereditaments and that no mortgagee under this power shall be bound to see to the application of the money so advanced and that my said trustees and trustee respectively shall have full power and authority to join in any transfer of any then existing mortgages of any of my said estates (real or copyhold) which may at any time be called in or required payment of by any mortgagees thereof and that such transfers shall include all the costs charges and expences incident thereto. I declare that the .... my trustees or trustee when herein made use of shall comprise the said Frederick Martin and Charles Pockney and the survivor of them and the executors or administrators of such survivor and their or his assigns and other the trustees or trustee to be appointed under the power for that purpose hereinafter referred to or by a Court of competent jurisdiction whilst they or he respectively shall be acting under the trusts hereof. I absolve my said trustees from responsibility for the receipts and defaults of each other and for involuntary losses and authorize them to retain and allow to each other all expences incurred in and about the execution of my Will. And I hereby revoke all former Wills. I declare that the several enactments and provisions of the Act passed in the twenty third and twenty fourth years of the reign of Her present Majesty Caption 145 shall (so far as the same may be applicable) be applied to and take effect as regards the exercise and execution of the trusts of this my Will. Proved at Lewes the 16th day of April 1866 by the oaths of Frederick Martin and Charles Pockney the executors to whom administration was granted. The testator William Durrant was late of Norlington in the parish of Ringmer in the County of Sussex carpenter and died on the 13th day of April 1865 at Norlington aforesaid.
