This is the last Will and Testament of me Michael Pennifold of Cuckfield in the County of Sussex Farmer I give and devise unto Edward Harmes of Cuckfield aforesaid Farmer and my Son in Law William Packham of the same place Farmer All and every my Freehold and Copyhold Mefsuages Lands Tenements and Hereditaments and all my other Real Estate whatsoverer and wheresoever of or to which I am now or at the time of my decease shall or may be seized pofsefsed or entitled at Law or in Equity To hold the same with their Appurtenances unto the said Edward Harmes and William Packham their Heirs and Assigns according to the nature and tenure thereof respectively Upon the Trusts hereinafter declared of and concerning the same (that is to say)Upon Trust that they he said Edward Harmes and William Packham or the Survivor of them or his Heirs do and shall pay the Rents Ifsues and profits of my said Freehold and Copyhold Mefsuages Lands Tenements and Hereditaments and other my said Real Estate unto my Wife Jane Pennifold for an during the Term of her natural Life provided she remains my Widow and unmarried And upon further Trust to permit my said Wife during her Widowhood to occupy at her option my said Mefsuages Lands Tenements Hereditaments and Real Estate or any part thereof she keeping the same during such Occupancy thereof in good Tenantable Repair And upon further Trust that they my said Trustees or the Survivor of them or his Heirs do and shall immediately or as soon as may be after the decease of my said Wife or her Marriage again which shall first happen absolutely sell and dispose of all and every my said Freehold and Copyhold Mefsuages Lands Tenements Hereditaments and other my said Real Estate and the Inheritance thereof respectively either by public Auction or private Contract and either altogether or in parcels and generally in such manner as they shall think expedient for the most money that shall be reasonably obtainable for the same with liberty to buy the said Hereditaments and Premises or any part thereof at any such Auction and afterwards to sell the same in manner aforesaid without being responsible for any lofs to be occasioned by such a postponed Sale and also to make and execute all such Deeds Conveyances Surrenders and Assurances in the Law whatsoever as they or he think fit or be advised to be necefsary for the completion of such Sale or Sales And I declare and direct that my said Trustees and Survivor of them and his heirs shall stand and be pofsefsed of and interested in the Monies to arise from the Sale and Disposition of my said Freehold and Copyhold Mefsuages Lands Tenements Hereditaments and of and in the Rents Issues and profits thereof until such Sale thereof as aforesaid (after payment thereout of all Expenses of and or attendant upon such Sale or Sales) Upon the Trust hereinafter exprefsed and declared of and concerning the same I give and bequeath unto the said Edward Harmes and William Packham All and every my personal Estate and Effects whatsoever and wheresoeverwhich I may die pofsefsed of interested in or entitled unto Upon Trust to permit my said Wife to have the free use and enjoyment of all my Household Goods and Furniture for and during the Term of her natural Life provided she remains my Widow and unmarried And upon further Trust that they my said Trustees or the Survivor of them his Executors or Administrators do and shall with the concurrence of my said Wife and if they or he shall in their or his discretion think it expedient so to do carry on my Business of a Farmer in or upon an Lands which may be in my Occupation at the time of my decease or in or upon any other Lands for and during the natural Life of my said Wife or for and during such part thereof as they or he with such Concurrence as aforesaid may think proper provided my said Wife shall so long continue my Widow and unmarried and do and shall pay the profits of my said Business to my said Wife for her own absolute use and benefit And upon further Trust that they my said Trustees or the Survivor of them or his Executors or Administrators do and shall from time to time during the Widowhood of my said Wife convert sell and dispose of such part and parts of my said personal Estate and Effects as shall not be required for the purpose of carrying on my said Farming Business (but exclusive of my said Household Goods and Furniture) and lay out and invest the Monies thereby arising in or upon some good and sufficient Security or Securities at Interest to be from time to time called in altered and varied as Occasion may require and do and shall pay the Dividends Interest and produce thereof to my said Wife for her own absolute use and benefit for and during her natural Life provided she remains my Widow and unmarried And from and immediately after the decease of my said Wife or he Marriage again which shall first happen Then upon further Trust that they my said Trustees or the Survivor of them his Executors or Administrators do and shall sell and convert into Money all and every my personal Estate and Effects whatsoever not consisting of Monies And I declare and direct that my said Trustees and the Survivor of them his Executors and Administrators shall stand and be pofsefsed of and interested in the Monies to arise from the Sale and Disposition of my said Freehold and Copyhold Mefsuages Lands Tenements and Hereditaments and Real Estate and from the Sale and Conversion of my said personal Estate and Effects and of and in all other Monies received by or belonging to them under or by virtue of this my Will Upon Trust to divide the same into eight equal parts of Shares and to pay one eighth part or Share unto my Daughter Mary the Wife of the said William Packham one other eighth part or Share unto my Son Joseph Pennifold one other eighth part or Share unto my Son John Pennifold one other eighth part or Share unto my Son Thomas Pennifold and one other eighth part or Share unto my Son Michael Pennifold and as to one other eighth part or Share Upon Trust after retaining thereout the Sum of Thirty Pounds to pay the residue thereof to my Daughter Elizabeth the Wife of John Broomfield And upon further Trust to pay the said Sum of Thirty pounds to my Grand-Daughter Fanny Pennifold the Daughter of the said Elizabeth Broomfield the said Sum of Thirty Pounds with all Accumulations (if any) to be paid to the said Fanny Pennifold upon her attaining the Age of twenty one years or upon her day of Marriage which shall first happen but in Case the said Fanny Pennifold shall depart this life under the said Age of twenty one years and unmarried then Upon further Trust to pay the said Sum of Thirty pounds with all Accumulations thereof if any to my said Daughter Elizabeth Broomfield for her own absolute use and benefit And as to one other eighth part or Share Upon Trust to pay one Moiety or equal half part thereof unto my Daughter Sarah the Wife of James Jeffery and the remaining Moiety or equal half part thereof unto my Grandson Henry Pennifold the Son of the said Sarah Jeffery the last mentioned Moiety with all Accumulations thereof (if any) to be paid to the said Henry Pennifold upon his attaining the Age of twenty one years or upon his day of Marriage which shall first happen but in Case the said Henry Pennifold shall depart this life under the said Age of twenty one years and unmarried then Upon further Trust to pay the last mentioned Moiety with all Accumulations thereof (if any) unto my Daughter Sarah Jeffery for her own absolute use and benefit And as to one other eighth part or Share Upon Trust to pay one Moiety or equal half part thereof unto my Daughter Sarah the Wife of James Jeffery and the remaining Moiety or equal half part thereof unto my Grandson Henry Pennifold the Son of the said Sarah Jeffery the last mentioned Moiety with all Accumulations thereof (if any) to be paid to the said Henry Pennifold upon his attaining the Age of twenty one years or upon his day of Marriage which shall first happen but in Case the said Henry Pennifold shall depart this life under the said Age of twenty one years and unmarried then Upon further Trust to pay the last mentioned Moiety with all Accumulations thereof (if any) unto my said Daughter Sarah Jeffery for her own absolute use and benefit And as to the remaining eighth part or Share Upon Trust to divide and pay the same between and unto my Grand-Children Charles Dayne Meads Frederick Meads Thomas Meads John Meads and Isabella Meads the Children of my late Daughter Jane Meads deceased share and share alike and I declare and direct that the Shares of my said last mentioned Grand-children shall be paid to them respectively as and when they respectively attain the Age of twenty-one Years or upon their respective days of Marriage which shall first happen and that in Case any or either of my said last mentioned Grand-children shall depart this Life under the Age of twenty one Years and unmarried as well as the original as the accruing Share or Shares of him her or them so dying shall go and belong to the Survivor or Survivors of my said last mentioned Grand-children and shall be paid to him her or them as and together with his her or their original Share or Shares And I declare and direct that the Legacies or Shares hereby bequeathed to my said Sons and Daughters respectively shall respectively become vested Interests immediately after my decease And that the Legacy or Share of each of my said Grand-children shall become a vested Interest as and when such Grand-child shall attain the Age of twenty one years or upon his or her day of Marriage which shall first happen And whereas I have contracted and Agreed with Elizabeth Kennard of Cuckfield aforesaid Spinster for the purchase of a Customary Cottage Lands and Hereditaments situate at Saint John’s Common in the Parish of Clayton and held of the Manor of Clayton at or for the price or Sum of five hundred and twenty five Pounds and have paid to her the Sum of three hundred and eighty pounds in part of the said purchase Money and have also entered into the profsefsion or am now in Receipt of Rents and profits of the same Hereditaments and premises But no Surrender or other Assurance of the said premises has been made to me by the said Elizabeth Kennard Now I do hereby direct that my said Trustees or the Survivor of them or his Heirs shall as soon as conveniently may be after my decease carry the said Contract into effect and procure the said Elizabeth Kennard or her Heirs to surrender and convey the said Hereditaments and Premises to them or him or their or his Heirs subject neverthelefs to a good and satisfactory Title being made to the said Premises and thereupon to obtain Admission to the same premises And I do hereby declare and direct that my said Trustees and the Survivor of them and his Heirs shall stand and be seized of the same Hereditaments and Premises and shall stand and be pofsefsed of and interested in the Rents Issues and profits thereof and of and in the Monies to arise from the Sale and Disposition thereof upon such and the same Trusts and for such and the same Ends and purposes in all respects as are hereinbefore mentioned expressed and declared of and concerning my said Real Estates hereinbefore devised and the Rents Issues and purchase Monies thereof Provided always and I do declare and direct that my said Trustees or the Survivor of them or his Heirs shall before they or shall under the Trusts hereinbefore contained proceed to a Sale of the said Hereditaments and Premises so contracted to be purchased of the said Elizabeth Kennard as aforesaid give to my Son Joseph Pennifold the option of becoming the purchaser thereof at a Price lefs by Ten per Cent than such price as the same Hereditaments and Premises shall be valued by two impartial persons to be named for that purpose one by my said Trustees or the Survivor of them or his Heirs and the other by my said Son or the Referee of two such persons and in Case my said son Joseph Pennifold shall agree to exercise such right of pre-emption then shall convey surrender and afsure the same Hereditaments and Premises to him and his Heirs accordingly or as he or they shall direct or appoint And I appoint the said Edward Harmes and William Packham joint Executors of this my Will And I declare and direct that the Receipt or Receipts in writing of the Trustees or Trustee for the time being of this my Will shall be a good and effectual discharge or discharges to any person or persons whomsoever paying transferring or delivering to them or him any Monies or Trust premises whatsoever according to or to be holden upon the Trusts hereof for all such Monies or Trust premises as shall in such Receipts respectively be acknowledged to be received and that such person or persons their his or her Heirs Executors Administrators or Assigns shall not afterwards be bound to see to the application of the same Monies or Trust premises or be accountable for the lofs misapplication or nonapplication thereof or any part thereof And I further declare that if the Trustees hereby appointed or either of them or any future Trustees or Trustee hereof shall die go to reside abroad desire to be discharged from decline or become incapable to act in the Trusts hereof while the same Trusts or any of them shall be subsisting Then and in every such Case it shall be lawful for the surviving or continuing Trustees or Trustee (if any) or for the Executors or Administrators of the last acting Trustee whether such surviving Trustees or Trustee or Executor or Administrator respectively shall be willing to act in other respects or not by any Writing or Writings signed by them or him in the presence of an attested by two or more credible Witnesses to substitute and appoint some other person or persons to be Trustees or Trustee hereof in the room of the Trustees or Trustee dying going to reside abroad desiring to be discharged or declining or becoming incapable to act as aforesaid And thereupon all such Conveyances Afsignments Surrenders Payments Transfers and Afsurances shall with all convenient speed be made and executes as shall efectually vest my Trust Estate in the acting Trustees or Trustee hereof for the time being upon the same Trusts and subject to the same powers and provisions as are herein declared and contained of an concerning the same or such of the same Trust powers and provisions as shall be then subsisting or capable of taking effect and that every new Trustee to be appointed as aforesaid shall be competent in all things to act in the Execution of the Trusts to which he shall be so appointed as fully and effectually and with all the same powers as Authorities as if he had been hereby originally appointed as Trustee in the place of the Trustee to whom he shall whether immediately or otherwise

The Will of Michael Pennifold late of Cuckfield within the Archdeaconry of Lewes Farmer deceased was proved the seventeenth day of July in the Year of our Lord One thousand eight hundred and forty three before the Reverend William Sergison Clerk Surrogate and so forth upon Oaths of Edward Harmes and William Packham the Executors in the said Will To whom was committed the Administration of the Goods etc They being first sworn well and faithfully to administer the same and so forth Sworn also that the Goods Chattels and Credits of the said deceased did not amount in Value unto One thousand pounds.
