Will of John Sayres of West Chiltington

In the name of God Amen The one & twentieth of MAY in the yeare of o[ur] lord god one Thousand six hundred & one And in the three & fortieth yeare of the Raigne of o[ur] most gracious sov[er]aigne lady Elizabeth by the grace of god of England France & Ireland Queene Defender of the faith I JOHN SAYERS of the parish of CHILTINGTON being whole in body & p[er]fect of memory Thanks be unto god knowing the [?] That ev[er]y man must dye but when & how it [shall come to be?] […] doe make & ordayne this my p[re]sent will & Testament in manner and forme following And first I bequeathe my Soule to Almighty god the father trusting that by the mercy of Jesus Christ my Saviour hee will except it amongst [… ] the glorious Company of heaven And I will my body to be buryed in the churchyard of CHILTINGTON amongst my ancestors there And touching the discposic[i]on of my Temporall goods

I will to the high church of CHICHESTER iiiid

I give to the repairac[i]ons of the church of CHILTINGTON iiis iiiid

And I will that there be distributed & given to the poore people of the said parish at my buryall xxs in breade and beere

It[e]m I will to the poore people of the said parish iiis iiiid yearly during the space of five yeares after my decease To be [?] yearly of the profits of my house and lands in CHILTINGTON aforesaid during the said Terme And yf it happen the said iiis iiiid shall not be paid at the feast of Easter according to my meaning being lawfully demanded Then I will the churchwardens of the said parish shall distreyne for the said iiis iiiid in and upon the said house and lands and the distresse there so taken to kepe unto such tyme as the said iiis iiiid shalbee yearly paid & distributed yearly unto the said poore people according to my meaning aforesaid And over and above the same iiis iiiid yearly … distreyne for iiis iiiid more in the name of […] so ofter as the said iiis iiiid shalbe behinde in manner & forme abovesaid during the said five years

It[e]m I give to ev[er]y of my god children viiid a peece

It[e]m I give & bequeath to JOHN SAYERS my eldest sonne the Table and forme in the hall one yealing [?] fate one great trough one great broake [?] the bench and shelves the best ladder one salting trough one kneading trough the sider mill w[i]th the sider vessells w[i]th all things thereto belonging the best great Chest

It[e]m I give & bequeath. unto WILLIAM SAYERS my sonne HENRY SAYERS my sonne ANNE & ELIZABETH my daughters my debts paid & my funeral expenses discharged then All my corne cattell hay & money the same to be equally devided between them foure

The rest of all my goods moveable & unmoveable unbequeathed I give unto WILLIAM SAYERS & HENRY SAYERS my sonnes whome I make my sole & onely Executo[u]rs of this my last will & Testament Also I do make & ordayne WILLIAM GRINFEILD my brother in law & THOMAS FEILD my neighbour both of THAKEHAM[?] to be ov[er]seers of this my last will & Testament And ev[er]y of them to have for theire paynes above theire Charges borne iiiis A peece

For the disposition of my lands I will that JOHN my said Sonne shall have my dwelling house barne mill house & buildings orchard gardens Brook & all my lands Tenements & hereditaments thereunto adjoining lying & being.in CHILTINGTON aforesaid called or knowne by the name of SEYARS and now in my occupac[i]on to have and to hold the said dwelling house barn and all other the p[re]mises to the said JOHN SAYERS my sonne & to the heyres male of his body lawfully begotten or to be begotten. And for lacke of heyres males of the Body of the said JOHN the remaynder thereof I will to WILLIAM my sonne & & to the heyres males of his body lawfully begotten And for lake of heyres males of the said WILLIAM my sonne the remainder thereof I will to HENRYE SAYERS my sonne & to the heyres males of his body lawfully begotten. And yf it happen my three sons JOHN WILLIAM & HENRY to dye without yssue of heyres males of their bodyes lawfully begotten as is aforesaid The remaynder of the foresaid premises I will to my right heyres for ever

I will to WILLIAM SAYRES my second sonne & to the heyres males of his body lawfully begotten all that my house barne & land called COMBERS conteyning by Estimac[i]on three 3 acres and one half of lands lying & being in the foresaid parrish of CHILTINGTON And for lack of heyres males of the body of the said WILLIAM the remaynder thereof to HENRY SAYRES my sonne of his bodye lawfully begotten And for lack of heyres males of HENRY my sonne the remaynder of the premises to JOHN SAYRES my eldest sonne & to the heyres males of his body lawfully begotten And yif it ... happen ... that my 3 sons ... dye without yssue of heyres male ... to my right heyres for ever ...
