Will of John Ashby of Mayfield

This is the last Will and Testament of me John Ashby of Mayfield in the County of Sussex yeoman touching the disposition of such temporal estate as it hath pleased almighty God of his goodness to bestow upon me as follows in the first place I direct that all such debts as I shall justly owe at the time of my decease my funeral expences the costs and charges of proving this my Will and all other incidental expences shall be paid and discharged as soon as conveniently may be after my decease and I give and devise unto my son Stephen Ashby all that my moiety or half part of and in all those messuages or tenements together with the buildings gardens lands hereditaments and appurtenances thereunto belonging containing by estimation twenty acres more or less situate lying and being at or near Southborough in the parish of Tonbridge in the County of Kent and which I purchased of Thomas Jeffery to hold to him my said son Stephen Ashby his heirs and assigns for ever. Also I give and bequeath unto my said son Stephen Ashby the legacy or sum of fifty pounds sterling to be paid to him within six months next after my decease to his own proper use and benefit and whereas I have advanced divers sums of money to my son James Ashby for which it is not my intention he shall be called to any account now I do by this my Will give and bequeath unto my said son James Ashby the legacy or sum of fifty pounds sterling to be paid to him within six months next after my decease to his own proper use and benefit and whereas I have also advanced to my daughter Elizabeth Waghorne widow the sum of two hundred pounds now I do hereby give and bequeath unto the said Elizabeth Waghorne the further legacy or sum of three hundred pounds sterling to be paid to her within twelve months next after my decease to her own proper use and benefit. Also I give and bequeath unto my daughter Catherine the wife of John Ashby the legacy or sum of five hundred and fifty pounds sterling to be paid to her within twelve months next after my decease to her own absolute use and benefit and whereas I have also advanced to my daughter Mary the wife of Benjamin Newnham different sums of money amounting together to three hundred and forty pounds now I do hereby give and bequeath unto my said daughter Mary the further legacy or sum of one hundred and sixty pounds sterling to be paid to her within twelve months next after my decease to her own proper use and benefit and all the rest residue and remainder of my ready money securities for money chattels effects and personal estate whatsoever and wheresoever I give and bequeath unto my son John Ashby to his own absolute use and benefit and I make nominate constitute and appoint my said son John Ashby and William Parkham of Bassetts Farm in the parish of Wadhurst in the said County of Sussex farmer joint executors of this my last Will and Testament and I do hereby order direct and request the said William Parkham to deduct and retain to his own use out of the monies coming to his hands all such loss costs charges and expences as he shall bear pay expend or be put unto in the due execution of this my Will together with a proper and sufficient allowance for his journies trouble and loss of time to be occasioned thereby. And lastly I do hereby revoke all former Wills by me made and declare this only to be my last Will and Testament. In witness whereof I the said John Ashby the testator have to each sheet of this my last Will and Testament contained in two sheets of paper set my hand and seal the sixteenth day of March in the year of our Lord one thousand eight hundred and nineteen.
