Will of Nicholas Barham of Wadhurst

In the name of God Amen The Fourteenth day of November in the yeare of our Lord God accordinge to the [---] of the Church of England one Thousand Six Hundred Fiftie and Two I Nicholas Barham of Wadhurst in the Countie of Sussex gent being [---] with sickness and consideringe the shortnes of life and the [---] there of do therefore in my perfect rememberance make and declare this to be my present Testament and last will in manner following (that is to say) first I commend my soule to the hands of Allmightie God my maker in full assurance of a resurection unto eternall life in and thorough the merritts and mediation of the Lord Christ Jesus my onlie Saviour and redeemer And I committ my bodie to the earth to be decently buried in the channcell of the Church of Wadhurst aforesaid Att the discretion of my Executor and overseers hereafter named Item I give and bequeath unto the poore people of Wadhurst aforesaid the sume of five pounds to be paid and distributed to and amongst them att the discretion of my Executor within Three Months next after my deceased Item I give and bequeath unto Elizabeth Ann and Constance Elliott the children of my daughter Elliott to each of them five pounds To be paid unto them Att their severall Ages of one and Twentie yeares or dayes of Marriage wth shall first happen And if either of them doo depart this life before their legacies become due or payable That then the legacies of such dyinge shall remayne to the Survivor or Survivors of them Item I give and bequeath unto John Barham and Elizabeth Barham the children of my daughter Barham the life some of five pounds a peece to be paid unto them [---] att their respective Ages of one and Twentie yeares or dayes of marriage wth shall first happen And if either of them depart this life before their legacies become payable then the same to be and remayne to the Survivor of them Item I give and bequeath unto Marie my loving wife the one halfe of all my Lynnon and [---] the one halfe of all my other houshold stuffe and plate whatsoever that is beinge and remaying within my Manor house called Butts (except onlie such houshold stuffe (Lynnen excepted) as are in the Hall Parlor and Parlor Chamber (Provided that shee take but the one halfe [---] of the good wth were heres at the tyme of our intermarriage) All the rest of my goods chattles plate houshold stuffe and utensills of husbandrie of what kind or nature [---] they and I doo give and bequeath unto my sonne John Barham whome I make sole Executor of this my last will and Testament And I doo nominated and request William Parkham of Salehurst and David Holland of Waddhurst aforesaid my sonnes in lawe and my approved and faithfull friends To be the overseers of this my said last will and to whome I give Twentie shillings a peece to be paid to them by my said Executor wth in Three Month nexte after my decease An as touching my reall estate That is to say my Lands Tenements and Hereditements I doo give and bequeath the same to my sonne John Barham his heirs and Assignes forever to the use of the said John Barham his heirs and assignes forever upon condition nevertheless that hee the said John Barham doo sell and [---] pay and discharge All my debts and all the legacies by me hereby bequeathed And I doo hereby renounce All former wills by me att aine tyme heretofore made In witness whereof I the said Nicholas Barham have to this my present testament and last will sett my hand and seale the day and yeare first above named Nicholas Barham Sealed signed published and declared to be the last will of the said Nicholas Barham in the presence of us Nicholas Saunders ~ William Hendlye ~ George Courthop ~ Gre Dyns

This will was proved att Westminster the one and twentith day of May in the yeare of our Lord God one thousand six hundred fiftie and three before the Judges for Probate of wills and grauntinge Administrations Entitu---] [---] for Probate of Wills and grauntinge Administrations by the oath of John Barham his sonne and sole Executor named in the said will To whom was committed Adminstration of all and singular the goods chattles and debts of the said deceased he beinge first legallie sworne well and truelie to Adminster the same
