In the Name of God Amen I William Heather of the Parish of Stedham in the County of Sussex Yeoman being in health of Body and of sound and perfect Mind and Memory (praised be God for the same)but considering nevertheless the uncertainty of this Life do make and declare this to be my last Will and Testament in manner and form following (that is to say) First and Principally I recommend my Soul to Almighty God hoping to be saved by and through the Merits and Death of Jesus Christ my only Saviour and Redeemer and my Body I commit to the Earth to be decently buried by my Executor herein after named And as to my Worldly Estate with which it hath pleased Almighty God to bless me I order give devise and bequeath the same as followeth (that is to say) Imprimis I will and direct that all my Debts shall be first paid and discharged Item I give and devise to my Brother John Heather All that my Messuage or Tenement Barn Buildings Gateroom Garden and several Closes of Land containing by Estimation Seven Acres (little more or less) thereunto adjoining and belonging with their and every of their Appurtenances called or known by the name of Copyd Hall or by whatsoever other Name or Names the same or any part thereof are or is called or known situate lying and being in the Parish of Chithurst in the County aforesaid and now in the Tenure or Occupation of William Bettesworth his Undertenants or Assigns To Hold to my said Brother John Heather and his Assigns for and during the Term of his natural Life he making no Wast nor Destruction thereupon and from and immediately after his Decease I give and devise the said Messuage or Tenement Barn Buildings Garden Closes of Land and Premises with their and every of their Appurtenances to my Cousins Thomas Heather of Midhurst in the County aforesaid Gentleman William Heather of Midhurst aforesaid Tanner and Richard Heather of the Inner Temple London Gentleman and to their Heirs and Assigns for ever as and to take as Tenants in Common and not as Joint tenants of the ffreehold Item I give and bequeath to my Cousin John Marner of Midhurst aforesaid Schoolmaster the Sum of one Shilling of lawful money of Great Britain to be paid to him within one Month next after the Decease of my said Brother John Heather by my Executor herein after named Item I give and bequeath to Joan Pitter Daughter of Richard Pitter the sum of one Pound and one Shilling Item I give and bequeath to the Person who shall be Tenant of the House wherein I now Dwell at the time of my Decease one half years Rent to be paid to them within one Month next after the Decease of my said Brother John Heather by my Executor herein after named Item after my Debts Legacies and ffuneral Expences are paid and discharged I give and bequeath to my said Brother John Heather the use and Usage of all the rest and residue of my Moneys Goods Chattels Personal Estate and Effects whatsoever and wheresoever for and during the term of his natural Life And from and immediately after his Decease I give and bequeath all the said rest and residue of my Moneys Goods Chattels Personal Estate and Effects whatsoever and wheresoever to my said Cousins Thomas Heather William Heather and Richard Heather to be equally divided amongst them And lastly I make and appoint my said Cousin Thomas Heather sole Executor of this my last Will and Testament hereby revoking all former Wills by me made In Witness whereof I the said William Heather the Testator have hereunto set my Hand and Seal the twenty eighth day of December in the twenty sixth Year of the Reign of our Sovereign Lord George the Second by the Grace of God King of Great Britain etc. And in the year of our Lord one thousand seven hundred and fifty two The mark of Wm Heather
