PRESENT,

The QUEEN's Most Excellent Majesty in Council.

WHEREAS the Ecclesiastical Commissioners for England have, in pursuance of the Act of the seventh and eighth years of Her Majesty chapter ninety-four of the Act of the thirteenth and fourteenth years of Her Majesty chapter ninety-four and of the Act of the thirty-second and thirty-third years of Her Majesty chapter ninety-four duly prepared and laid before Her Majesty in Council a scheme or representation bearing date the second day of August, in the year one thousand eight hundred and ninety-four, in the words and figures following, that is to say:—

"We, the Ecclesiastical Commissioners for England acting under the provisions of the Act of the seventh and eighth years of Your Majesty chapter ninety-four, of the Act of the thirteenth and fourteenth years of Your Majesty, chapter ninety-four and of the Act of the thirty-second and thirty-third years of Your Majesty chapter ninety-four, have prepared and now humbly lay before Your Majesty in Council the following scheme or representation for altering the boundaries of the new parish of Saint Wilfrid Cuckfield in the county of Sussex and in the diocese of Chichester.

"Whereas by the authority of an Order of Your Majesty in Council bearing date the sixteenth day of February in the year one thousand eight hundred and sixty-six and published in the London Gazette upon the twentieth day of the same month a part of the parish of Cuckfield in the county and diocese aforesaid was assigned as a district chapelry to the consecrated church of Saint Wilfrid situate at Haywards Heath within the limits of the said parish of Cuckfield and the same district chapelry was called The District Chapelry of Saint Wilfrid Cuckfield.

"And whereas the said district chapelry of Saint Wilfrid Cuckfield has under the provisions of the Act of the nineteenth and twentieth years of Your Majesty, chapter one hundred and four, become a new parish of the character contemplated by that Act and by the Act of the sixth and seventh years of Your Majesty, chapter thirty-seven, and by- the above-mentioned Act of the thirty-second and thirty-third years of Your Majesty chapter ninety-four.

"And whereas it has been represented to us and it appears to us to be expedient that the boundaries of the said new parish of Saint Wilfrid Cuckfield should be altered in the manner hereinafter mentioned.

"Now therefore with the consent of the Right Reverend Richard Bishop of the said diocese of Chichester (in testimony whereof he has signed and sealed this scheme or representation) we the said Ecclesiastical Commissioners humbly represent recommend and propose that from and after the day of the dale of publication in the London Gazette of any Order of Your Majesty in Council ratifying this scheme or representation and without any assurance in the law other than such duly gazetted Order the boundaries of the said new parish of Saint Wilfrid Cuckfield shall be altered (first) so that all that portion of the now parish of Saint John's Common in the county and diocese aforesaid which is described in the first part of the Schedule hereunder written and is delineated and set forth upon the map or plan hereunto appended and is thereon coloured pink shall be annexed to and shall in future form part of the said new parish of Saint Wilfrid Cuckfield and (secondly) so that all that portion of the parish or parochial chapelry of Wivelsfield in the county and diocese aforesaid which is described in the second part of the same schedule and is delineated and set forth upon the said map or plan and is thereon coloured green shall be annexed to and shall in future form part of the said new parish of Saint Wilfrid Cuckfield.

"And we further represent recommend and propose that nothing herein contained shall prevent us from representing recommending or proposing any other measures relating to the matters aforesaid or any of them in accordance with the provisions of the hereinbefore-mentioned Acts or of any of them or of any other Act of Parliament

"The SCHEDULE to which the foregoing Scheme or Representation has reference.

"The territory to be annexed to the new parish of Saint Wilfrid Cuckfield in the county of Sussex, and in the diocese of Chichester, comprising :—

"I. All that portion of the new parish of Saint John's Common in the same county and diocese which is bounded upon the east by the hereinafter described portion of the parish or parochial chapelry of Wivelsfield in the county and diocese aforesaid upon the north by the said new parish of Saint Wilfrid Cuckfield and upon the remaining sides that is to say upon the west and upon the south by an imaginary line commencing upon the boundary which divides the said new parish of Saint Wilfrid Cuckfield from the new parish of Saint John's Common aforesaid At the centre of Ashenground Bridge which carries Ashenground-road over the main line of the London Brighton and South Coast Railway and extending thence southward along the middle of the said line of railway for a distance of thirty-five chains or thereabouts to the centre of the bridge called or known as High Bridge which carries Rookery-lane over the same line of railway and extending thence north-eastward along the middle of the last-named Line for a distance of forty-one and a half chains or thereabouts to a point at the junction of the same lane with the road called Scrace's Hill and with Asylum-road upon the boundary which divides the said new parish of Saint John's Common from the parish or parochial chapelry of Wivelsfield aforesaid.

"II. And also all that contiguous portion of the said parish or parochial chapelry of Wivelsfield which is bounded upon the greater part of the north-east and upon the north by the new parish of Saint Wilfrid Cuckfield afore said upon the west by the above-described portion of the new parish of Saint John's Common aforesaid and upon the remaining sides that is to say upon the remaining part of the north-east by an imaginary line commencing upon the boundary which divides the said new parish of Saint John's Common from the parish or parochial chapelry of Wivelsfield at the above-mentioned point at the junction of Rookery-lane aforesaid with the road called Scrace's Hill and with Asylum-road aforesaid and extending thence north-eastward along the middle of the last-mentioned road for a distance of forty-two chains or thereabouts to its junction with the road which leads from Lyoth Common past Birch Green and Franklyns towards Haywards Heath and extending thence north-westward along the middle of the last-mentioned road for a distance of three and -a half chains or there abouts to a point opposite to the southern end of the fence which forms the western boundary of Frankland's Wood and extending thence north-eastward and in a direct line for a distance of one chain to the boundary on the northern side of the last-mentioned road and at the south-western corner of Frankland's Wood aforesaid which boundary divides the said parish or parochial chapelry of Wivelsfield from the new parish of Saint Wilfrid Cuckfield aforesaid."

And whereas drafts of the said scheme or representation have in accordance with the provisions of the said Acts been transmitted to the patrons and to the incumbents of the cures affected by the arrangements which are contemplated by such scheme or representation.

And whereas one calendar month has elapsed since the date of the transmission of the drafts of the said scheme or representation as aforesaid and the said patrons and incumbents have offered no objections to such scheme or representation.

And whereas the said scheme or representation has been approved by Her Majesty in Council: Now, therefore, Her Majesty, by and with the advice of Her said Council, is pleased hereby to ratify the said scheme or representation, and to order and direct that the same and every part thereof shall be effectual in law immediately from and after the time when this Order shall have been duly published in the London Gazette pursuant to the said Acts ; and Her Majesty, by and with the like advice, is pleased hereby to direct that this Order be forthwith registered by the Registrar of the said diocese of Chichester.
