PRESENT,

The KING'S Most Excellent Majesty in Council.

WHEREAS by section twenty-six of the Pluralities Act, 1838, after reciting that whereas in some instances tithings, hamlets, chapelries, and other places or districts may be separated from the parishes or mother churches to which they belong, with great advantage, and places altogether extra-parochial may in some instances with advantage be annexed to parishes or districts to which they are contiguous, or be constituted separate parishes for ecclesiastical purposes, it is, amongst other things, enacted "That when with respect to his own diocese it shall appear to the Archbishop of the Province, or when the Bishop of any diocese shall represent to the said Archbishop that any such tithing, hamlet, chapelry, place, or district within the diocese of such Archbishop, or the diocese of such Bishop, as the case may be, may be advantageously separated from any parish or mother church, and either be constituted a separate benefice by itself or be united to any other parish to which it may be more conveniently annexed, or to any other adjoining tithing, hamlet, chapelry, place, or district, parochial or extra-parochial, so as to form a separate parish or benefice, or that any extra-parochial place may with advantage be annexed to any parish to which it is contiguous, or be constituted a separate parish for ecclesiastical purposes; and the said Archbishop or Bishop shall draw up a scheme in writing (the scheme of such Bishop to be transmitted to the said Archbishop for his consideration) describing the mode in which it appears to him that the alteration may best be effected, and how the changes consequent on such alteration in respect to ecclesiastical jurisdiction, glebe-lands, tithes, rent charges, and other ecclesiastical dues, rates, and payments, and in respect to patronage and rights to pews, may be made with justice to all parties interested ; and if the patron or patrons of the benefice or benefices to be affected by such alteration shall consent in writing under his or their hands to such scheme, or to such modification thereof as the said Archbishop may approve, and the said Archbishop shall, on full consideration and inquiry, be satisfied with any such scheme, or modification thereof, and shall certify the same and such consent as aforesaid, by his report to His Majesty in Council, it shall be lawful for His Majesty in Council to make an Order for carrying such scheme, or modification thereof, as the case may be, into effect."

And whereas the Right Reverend Charles John, Lord Bishop of Chichester, hath, pursuant to the enactment aforesaid, represented in a writing dated the eighth day of August, one thousand nine hundred and eight, to the Right Honourable and Most Reverend Randall Thomas, Lord Archbishop of Canterbury, as follows:—

"I, the Right Reverend Charles John, Lord Bishop of Chichester, do hereby represent to your Grace:—

"That there is in the county of Sussex and my diocese of Chichester the rectory of Westmeston otherwise Westmerston otherwise Westmynston otherwise Westmyston with the chapel of Chiltington comprising the parish of Westmeston and the hamlet or parish of East Chiltington the boundaries whereof are well known and defined and which is hereinafter referred to as the rectory or parish of Westmeston.

"That the said hamlet or parish of East Chiltington lies wholly detached from the said parish of Westmeston the parishes of Plumpton and Streete lying between Westmeston and East Chiltington along their whole breadth and that the church or chapel situate at East Chiltington which is now a chapel-of-ease to the parish church of Westmeston aforesaid is distant from the said parish church three miles or thereabouts.

"That the population of the said hamlet or parish of East Chiltington amounts according to the census of one thousand nine hundred and one to three hundred and ninety persons for whom the said chapel affords sufficient accommodation.

"That the said hamlet or parish of East Chiltington appears to have been immemorially treated as a separate parish for all civil purposes and also that baptisms churchings marriages and burials have heretofore been and are now performed in the said chapel.

"That there is also in the said county and my diocese of Chichester another detached portion of the said parish of Westmeston known as Novington comprising three hundred and thirty-three acres one rood and twenty-four perches or thereabouts and lying immediately to the south of the said hamlet or parish of East Chiltington to which it is contiguous along its whole northern boundary and which contains a population of about fifty persons and which is situate about two miles from the parish church of Westmeston from which parish it is also divided by the whole breadth of the parishes of Plumpton and Streete.

"That there is also in the said county and my said diocese the said parish of Plumpton the boundaries whereof are well known and defined and which is contiguous along its whole eastern boundary to the said parish of East Chiltington and the said detached portion of the parish of Westmeston known as Novington.

"That the geographical position of the said parishes of Westmeston East Chiltington and Plumpton appears upon the plan which accompanies this representation and that on such plan the parish of Plumpton is coloured blue the parish of Westmeston is coloured pink the said detached portion of the parish of Westmeston known as Novington being coloured brown and the hamlet or parish of East Chiltington being coloured green.

"That according to the last census the population of the said parish of Westmeston exclusive of Novington and East Chiltington amounts to two hundred and thirty-four persons and the population of the said parish of Plumpton is five hundred, and ninety-five persons.

"That it does not appear that any of the inhabitants or landowners of the said hamlet or parish of East Chiltington or of the said detached portion of the parish of Westmeston known as Novington possess any legal right by faculty or otherwise to the exclusive right of any pews or sittings in the chapel of Chiltington aforesaid or in the said parish churches of Westmeston or Plumpton respectively.

"That the patronage of the said benefice of Westmeston with the chapel of Chiltington belongs to William Henry Campion of Danny Sussex Esquire C.B., and the patronage of the rectory of Plumpton to the Reverend John

Peckham Skirrow Woodward.

"That the Incumbent of the said benefice of Westmeston with the chapel of Chiltington is the Reverend Algernon Charles Lucey and the rector of the said benefice of Plumpton is the said John Peckham Skirrow Woodward.

"That it appears to me that the said hamlet or parish of East Chiltington and also the said detached portion of the parish of Westmeston aforesaid known as Novington may under the provisions of the Pluralities Act 1838 be advantageously separated from the said rectory of Westmeston and be united to the rectory of Plumpton for ecclesiastical purposes.

"That pursuant to the directions contained in the twenty-sixth section of the said Act of Parliament I have drawn up a scheme in writing appended to this representation describing the mode in which it appears to me that the alterations above proposed may best be effected and how the changes consequent on such alteration in respect to ecclesiastical jurisdiction glebe lands tithes rent charges and other ecclesiastical dues rates and payments and in respect to patronage and rights to pews may be made with justice to all parties interested and I do submit the same to your Grace together with the consents in writing of the said William Henry Campion the Patron of the said benefice of Westmeston of the said John Peckham Skirrow Woodward as the Patron and Incumbent of the said rectory of Plumpton and of the said Algernon Charles Lucey as Incumbent of the said benefice of Westmeston to the intent that your Grace may if after full enquiry and consideration you should be satisfied with the said scheme certify the same and such consents by your report to His Majesty in Council."

And whereas the said scheme drawn up by the said Bishop and the consents referred to in the said representation are as follows:—

SCHEME.

"That there shall be separated from the said rectory of Westmeston with the chapel of East Chiltington and be united to the said rectory of Plumpton for ecclesiastical purposes all that the hamlet or parish of East Chiltington aforesaid and also all that the said detached portion of the said parish of Westmeston known as Novington coloured respectively green and brown on the plan which accompanies this representation.

"That the said hamlet or parish of East Chiltington and the said detached portion of the parish of Westmeston known as Novington shall respectively be subject to the same ecclesiastical jurisdiction as the said rectory of Plumpton and the Incumbent of the said rectory of Plumpton shall have exclusive cure of souls within the limits of the same.

"That there shall be assigned and attached to the said rectory of Plumpton the yearly rent charges of three hundred and twenty-one pounds ten shillings and eleven pence per annum given in lieu of the tithes of the lands within the hamlet or parish of East Chiltington and the said detached portion of the parish of Westmeston known as Novington under the provisions, of the Act for the Commutation of Tithes in England and Wales being the aggregate of the several sums assessed upon the aforesaid lauds by the instrument of tithe apportionment for the said parish of Westmeston.

"That all fees and other ecclesiastical dues and payments for churchings marriages and burials and other ecclesiastical offices solemnized or performed within the chapelry or chapel of East Chiltington and the parish or parish church of Plumpton in respect of the said chapelry and the said detached portion of the parish of Westmeston known as Novington respectively, shall from henceforth belong to the Incumbent of the said rectory of Plumpton.

"That, the inhabitants of the said chapelry of East Chiltington and of the said detached portion of the parish of Westmeston known as Novington respectively shall not in future be entitled to any accommodation in the said parish church of Westmeston and shall be exonerated from all liability to repair the said parish church but shall be entitled in common with the parishioners of the said parish of Plumpton to accommodation in the parish church of Plumpton and shall be liable subject to the provisions of the Compulsory Church Rates Act 1868 to the repairs of the ancient chapel of East Chiltington and of the said parish church of Plumpton.

CONSENTS.

"We William Henry Campion of Danny in the county of Sussex, Esquire, C.B., the patron or person entitled to present to the rectory of Westmeston with the chapel of Chiltington in the county of Sussex and diocese of Chichester in case the same were now vacant and the Reverend Algernon Charles Lucey, Clerk, Incumbent of the said benefice and the Reverend John Peckham Skirrow Woodward, Clerk, Rector of the rectory of Plumpton in the same county and diocese and the patron or person entitled to present thereto if the same were now vacant, do hereby respectively signify to your Grace our consent to the scheme hereinbefore proposed and set forth and to every matter and thing therein contained.

"In witness whereof we have respectively hereto set our hands this eighteenth day of August one thousand nine hundred and eight.

"J. P. S. Woodward."

And whereas the said scheme hath been transmitted by the said Bishop to the said Archbishop for his consideration:

And whereas the said Archbishop being satisfied with the said scheme hath certified the same and the consents aforesaid to His Majesty in Council by his report dated the second day of October, one thousand nine hundred and eight, which said report is in the words and figures following:—

"We the undersigned Randall Thomas Archbishop of the province of Canterbury do hereby report to your Majesty in Council—

"That the Right Reverend Charles John Lord Bishop of Chichester has represented unto us (amongst other things):

"That there is in the county of Sussex and his diocese of Chichester the rectory of Westmeston, otherwise Westmerston otherwise Westmynston otherwise Westmyston with the chapelry of Chiltington annexed.

"That such parish of Westmeston includes a detached hamlet, parish or portion known as East Chiltington and also another detached portion known as Novington.

"That there is also in the said county and his diocese of Chichester the parish of Plumpton which is contiguous along its whole eastern boundary to the said hamlet or parish of East Chiltington and to the said detached portion of the parish of Westmeston known as Novington.

"That it appears to the said Lord Bishop that under the provisions of the Pluralities Act 1838 the said hamlet or parish of East Chiltington and also the said other detached portion of the parish of Westmeston known as Novington the boundaries whereof are more particularly described in the scheme hereunto annexed and delineated in the map or plan attached to such scheme may severally be advantageously separated from the said rectory of Westmeston and be united to the rectory of Plumpton for ecclesiastical purposes only.

"That pursuant to the directions contained in the said Act the said Lord Bishop has drawn up a scheme in writing describing the mode in which it appears to him that the proposed alterations may best be effected and how the changes consequent on such alterations in respect to ecclesiastical jurisdiction glebe lands tithes rent charges and other ecclesiastical dues rates and payments and in respect to patronage and rights to pews may be made with justice to all parties interested, which scheme together with the consents thereto in writing of William Henry Campion the patron or person entitled to present to the rectory of Westmeston with the chapelry of Chiltington in case the same were now vacant and the Reverend Algernon Charles Lucey, Clerk, Incumbent of the said benefice and the Reverend John Peckham Skirrow Woodward, Clerk, Rector of the rectory of Plumpton and also the patron or person entitled to present thereto if the same were now vacant, has been transmitted to us by the said Lord Bishop for our consideration.

"The representation and scheme of the said Lord Bishop and the consents above referred to are hereunto annexed.

"And we the said Archbishop being on full consideration and inquiry satisfied with the said scheme do hereby pursuant to the said Pluralities Act, 1838, certify the same and such consents as aforesaid to Your Majesty in Council to the intent that Your Majesty in Council may in case Your Majesty in Council shall think fit so to do make and issue an Order for carrying the said scheme into effect.

Now, therefore, His Majesty in Council by and with the advice of His said Council is pleased to order, as it is hereby ordered, that the said scheme be carried into effect.
