Date:

Body:

At the Court at Buckingham Palace, the 9th day of May, 1907.

PRESENT,

The KING'S Most Excellent Majesty in Council.

WHEREAS the Ecclesiastical Commissioners for England have, in pursuance of the Act of the eighth and ninth years of Her late Majesty Queen Victoria, chapter seventy; of the Act of the fourteenth and fifteenth years of Her said late Majesty, chapter ninety-seven; and of the Act of the nineteenth and twentieth years of Her said late Majesty, chapter fifty-five; duly prepared and laid before His Majesty in Council a representation, bearing date the eleventh day of April, in the year one thousand nine hundred and seven, in the words and figures following, that is to say:—

"We, the Ecclesiastical Commissioners for England, in pursuance of the Act of the eighth and ninth years of Her late Majesty Queen Victoria, chapter seventy, of the Act of the fourteenth and fifteenth years of Her said late Majesty, chapter ninety-seven, and of the Act of the nineteenth and twentieth years of Her said late Majesty, chapter fifty-five, have prepared and now humbly lay before Your Majesty in Council the following representation as to the assignment of a consolidated chapelry to the consecrated church of the Holy Trinity, situate at Hurst Green within the parish of Etchingham in the county of Sussex and in the diocese of Chichester.

"Whereas at certain extremities of the said parish of Etchingham and of the parish of Salehurst in the said county and diocese, which said extremities lie contiguous one to another, and are described in the schedule hereunder written, there is collected together a population which is situate at a distance from the several churches of such parishes.

"And whereas it appears to us to be expedient that certain contiguous portions (being the portions containing the population aforesaid) of the said parish of Etchingham and of the said parish of Salehurst should be formed into a consolidated chapelry for all ecclesiastical purposes, and that the same should be assigned to the said church of the Holy Trinity situate at Hurst Green as aforesaid.

"Now, therefore, with the consent of the Right Reverend Ernest Roland, Bishop of Chichester, as such Bishop and also as the Patron of the rectory of the said parish of Etchingham, and with the consent of Charles Stewart Hardy, of Chilham Castle, Kent, Esquire, one of Your Majesty's Justices of the Peace, as the Patron of the vicarage of the said parish of Salehurst (in testimony whereof they, the said consenting parties, have respectively signed and sealed this representation), we, the said Ecclesiastical Commissioners for England, humbly represent that it would, in our opinion, be expedient that all those contiguous portions of the said parish of Etchingham and of the said parish of Salehurst which are described in the schedule hereunder written, all which portions, together with the boundaries thereof, are delineated and set forth on the map or plan hereunto annexed, should be united and formed into one consolidated chapelry for the said church of the Holy Trinity situate at Hurst Green as aforesaid, and that the same should be named 'The Consolidated Chapelry of Hurst Green.'

"We, therefore, humbly pray that Your Majesty will be graciously pleased to take the premises into Your Royal consideration, and to make such Order in respect thereto as to Your Majesty in Your Royal wisdom shall seem meet.

"The SCHEDULE to which the foregoing Representation has reference.

"The Consolidated Chapelry of Hurst Green, comprising:—

"I. All that portion of the parish of Etchingham, in the county of Sussex and in the diocese of Chichester, which is bounded upon the south-east by the parish of Salehurst, in the said county and diocese, upon the east partly by the last-named parish and partly by the parish of Hawkhurst, partly in the county of Kent and partly in the said county of Sussex and wholly in the diocese of Canterbury, upon the north by the last-named parish upon the north-west and upon part of the west by the parish of Ticehurst in the said county of Sussex and in the said diocese of Chichester, and upon the remaining sides that is to say, upon the remaining part of the west and upon the south-west, by an imaginary line commencing upon the boundary which divides the said parish of Ticehurst from the said parish of Etchingham at the point where the River Limden is joined by the stream which flows through Borzell Wood, and extending thence generally southward, along the middle of the River Limden for a distance of thirty-nine chains or thereabouts to the centre of Tysie Bridge which carries Tysie-lane across such river, and extending thence first eastward and then south-eastward along the middle of Tysie-lane for a distance of twenty-six chains or thereabouts to its junction at Burgh Hill with the road leading from Hurst Green over Burgh Hill to Etchingham, and extending thence eastward in a straight line for a distance of twenty-four chains or thereabouts (thereby crossing the road leading from Hurst Green past Haremere Hall to Etchingham) to the point on the eastern side of such road at the angle formed by the boundary which divides the said parish of Etchingham from the said parish of Salehurst.

"II. And also all that contiguous portion of the said parish of Salehurst which is bounded upon the west by the said parish of Etchingham, upon the north by the said parish of Hawkhurst, upon the north-west partly by the last-named parish and partly by a detached portion of the parish of Sandhurst, in the said county of Kent and in the said diocese of Canterbury, and upon the remaining sides, that is to say, upon the south-east and upon the south by an imaginary line commencing upon the boundary which divides the said county of Kent from the said county of Sussex and also the said detached portion of the parish of Sandhurst from the said parish of Salehurst at the centre of the bridge which carries the road leading from Hawkhurst to Battle over the stream which flows through Silverhill Wood, Trough Wood and Brickhurst Wood into Kent Ditch, and extending thence first north-westward and then south-westward up the middle of the said stream for a distance of two miles or thereabouts to the western corner of Silverhill Wood upon the eastern side of the roadway or footpath which leads to the White Horse Inn, and extending thence first westward to the middle of the said roadway or footpath and afterwards first north-westward and then westward along the middle of the said roadway or footpath for a distance of twenty-five chains or thereabouts to its junction with the high road from London to Hastings nearly opposite to the White Horse Inn, and extending thence westward across the said high road for a distance of two chains or thereabouts to the fence forming the southern boundary of the house and premises known as the White Horse Inn and extending thence westward along the said fence and along the fences forming the southern boundaries of the closes numbered one, two, three and four upon the map or plan annexed to this representation and of Hounsell Wood for a distance of forty-nine chains or thereabouts to the south-western corner of Hounsell Wood, and extending thence westward in a straight line for a distance of forty-two chains or thereabouts (thereby crossing the road leading from Bugshill Farm to Hurst Green) to the point where the boundary which divides the said parish of Salehurst from the said parish of Etchingham crosses the middle of the Tunbridge Wells and Hastings branch line of the South Eastern and Chatham Railway."

And whereas the said representation has been approved by His Majesty in Council: now, therefore, His Majesty, by and with the advice of His said Council, is pleased hereby to ratify the said representation, and to order and direct that the same and every part thereof shall be effectual in law immediately from and after the time when this Order shall have been duly published in the London Gazette pursuant to the said Acts; and His Majesty, by and with the like advice,is pleased hereby to direct that this Order be forthwith registered by the Registrar of the said diocese of Chichester.
