PRESENT,

The QUEEN's Most Excellent Majesty in Council.

WHEREAS the Ecclesiastical Commissioners for England have, in pursuance of the Act of the eighth and ninth years of Her Majesty, chapter seventy, section nine; and of the Act of the nineteenth and twentieth years of Her Majesty, chapter fifty-five, section one, duly prepared and laid before Her Majesty in Council, a representation bearing date the fourteenth day of January, in the year one thousand eight hundred and fifty-eight, in the words following; that is to say:

"We, the Ecclesiastical Commissioners for England, in pursuance of the Act of the eighth and ninth years of your Majesty, chapter seventy, section nine, and of the Act of the nineteenth and twentieth years of your Majesty, chapter fifty-five, section one, have prepared, and now humbly lay before your Majesty, the following representation as to the assignment of a consolidated chapelry to the consecrated church of Saint John the Baptist, situate at Tidebrook, in the parish of Wadhurst, in the county of Sussex, and diocese of Chichester,

"Whereas it appears to us to be expedient that certain contiguous parts of the parishes of Wadhurst and Mayfield, in the said county and diocese, should be formed into a consolidated chapelry for all ecclesiastical purposes, and that the same should be assigned to the said church of Saint John the Baptist, situate at Tidebrook aforesaid.

"Now, therefore, with the consent of the Right Reverend Ashhurst Turner, Bishop of Chichester; of the Warden, Fellows, and Scholars of Wadham College, in the University of Oxford, patrons of the said parish of Wadhurst; and of the Reverend Henry Thomas Murdock Kirby, patron of the said parish of Mayfield, in testimony whereof the said Ashhurst Turner, Bishop of Chichester, and Henry Thomas Murdock Kirby, have signed and sealed this representation, and, the said Warden, Fellows and Scholars have hereunto affixed their common seal, we humbly represent that in our opinion it would be expedient that all those contiguous parts of the said parishes of Wadhurst and Mayfield described in the schedule hereunder written, all which parts, together with the boundaries thereof are delineated und set forth on the map or plan hereunto annexed, should be united into one consolidated chapelry for the said church at Tidebrook aforesaid, and that the same should be named 'The Consolidated Chapelry of Tidebrook.'

"And we further represent that it has been mutually agreed between the said Warden, Fellows, and Scholars and Henry Thomas Murdock Kirby, testified as aforesaid, that the right of presentation and appointment to the church of such consolidated chapelry should belong to and be exercised alternately by the incumbents for the time being of the said parishes of Wadhurst and Mayfield, and that the first turn should belong to the incumbent of the said parish of Wadhurst.

"We, therefore, humbly pray that your Majesty will be graciously pleased to take the premises into your Royal consideration and to make such order in respect thereto as to your Majesty, in your Royal wisdom, shall seem meet."

"The SCHEDULE to which the foregoing Representation has reference.

"All that part of the parish of Wadhurst, in the county of Sussex, and in the diocese of Chichester, which is situate to the south of an imaginary line extending from the boundary between the said parish and the parish of Mayfield, along the middle of a rivulet or stream called Snape Brook as far as a point marked by a boundary stone placed on the south-western bank of such stream at the spot indicated by the letter C on the map or plan hereunto annexed, and extending thence in a westernly direction in a straight line to a point in the middle of the road leading from Beal’s Oak to Newhouse, opposite to a boundary stone placed on the eastern side of such road, at the spot marked D on the said map, extending thence in the same direction along the middle of such last mentioned road to the middle of the road leading from Rushes Cross to Best Beech Hill, extending thence in a northernly direction along the middle of such last mentioned road, crossing the road leading from Best Beech Hill to Mark Cross to a point situate at a distance of one hundred yards north of the middle of the last mentioned road, extending thence parallel to the middle of the last mentioned road, and at the like distance of one hundred yards there from to the boundary of the parish of Rotherfield : And also all that part of the parish of Mayfield, in the said county and diocese, which is situate to the north of an imaginary line extending from the boundary of the parish of Ticehurst, along the middle of a rivulet or stream called the Bother River as far as the middle of the road leading from Merrywether Mill to Sharnden; extending thence in a Northernly direction in a straight line to a point in the middle of the road leading from Tidebrook to a place called "Colkin's Mill," opposite to a boundary stone placed on the western side of such load at the spot marked E on the said map ; and extending thence in a north-westernly direction parallel to, but at a distance of one hundred yards south of, the middle of the road leading from Rushes Cross to Stile House, as far as the boundary of the parish of Rotherfield."

Her Majesty having taken the said representation, together with the map thereunto annexed, into consideration, was pleased, by and with tin advice of Her Privy Council, to approve thereof, and to order, and it is hereby ordered, that the consolidated chapelry therein mentioned for the consecrated church of Saint John the Baptist, situate at Tidebrook, in the parish of Wadhurst, be accordingly formed, and that the agreement mentioned in the said representation with respect to the right of presentation and appointment of an incumbent or perpetual curate to serve the said church, be carried into effect agreeably to the provisions of the said Act, and that the said right of presentation and appointment of an incumbent or perpetual curate to serve the said church shall belong to, and be exercised alternately by, the incumbents for the time being of the parishes of Wadhurst and Mayfield, and that the first turn shall belong to the incumbent of the said parish of Wadhurst; and Her Majesty is further pleased to direct that this order be forthwith registered by the Registrar of the diocese of Chichester.
