PRESENT,

The KING'S Most Excellent Majesty in Council.

WHEREAS the Right Reverend George, Lord Bishop of Chichester, has, under Section 26 of the Pluralities Act, 1838, made a Representation to the Right Honourable and Most Reverend Cosmo Gordon, Lord Archbishop of Canterbury, in the following terms: —

"I, the Right Reverend George, Lord Bishop of Chichester, in pursuance of the twenty-sixth section of the Pluralities Act, 1838, do hereby represent to your Grace that there are in the County of Sussex and my Diocese of Chichester the Vicarage of the Parish Church of Pagham and the Vicarage of the Parish Church of Bognor St. John and the District Chapelry of St. Richard Aldwick the limits and boundaries of the said Parishes and District Chapelry respectively being well known.

"That on the eastern side of the said District Chapelry of St. Richard Aldwick and immediately abutting thereon lies a certain contiguous part of the said Parish of Pagham (coloured green on the plan annexed hereto and hereinafter referred to as the contiguous area) which abuts on the western boundary of the said Parish of Bognor St. John and which I consider might with advantage be annexed to the said Parish of Bognor St. John.

"That the boundaries of the said Parishes of Pagham and Bognor St. John and the said District Chapelry of St. Richard Aldwick are delineated on the plan annexed hereto and thereon the said Parish of Pagham is coloured yellow and the said Parish of Bognor St. John is coloured red and the said District Chapelry of St. Richard Aldwick is coloured blue.

"That the population of the said Parish of Pagham is approximately eight hundred and fifty persons and the population of the said Parish of Bognor St. John is approximately eight thousand persons.

"That the population of the contiguous area is approximately five hundred persons.

"That the said Parish Church of Bognor St. John is conveniently situate for and adapted to the accommodation of the inhabitants of the contiguous area the most distant portion being one mile and a quarter more or less from the said Parish Church of Bognor St. John.

"That good roads lead from all parts of the contiguous area to the said Parish Church of Bognor St. John.

"That it does not appear that any of the inhabitants or landowners of the contiguous area possess any legal right by faculty or otherwise to the exclusive right of any pews or sittings in the said Parish Churches of Pagham and Bognor St. John respectively.

"That the Patronages of the said Vicarage of the Parish Church of Pagham and of the said Vicarage of the Parish Church of Bognor St. John belong to your Grace.

"That the Vicar of the said Vicarage of the Parish Church of Pagham is the Reverend Grosvenor Goode Knox and the Vicar of the said Vicarage of the Parish Church of Bognor St. John is The Reverend Prebendary Kenneth Clarke.

"That it appears to me that the contiguous area may be advantageously separated from the said Parish of Pagham and annexed to the said Parish of Bognor St. John under the provisions of the Act of Parliament passed in the Session holden in the first and second years of the reign of Her late Majesty Queen Victoria, chapter one hundred and six.

"That pursuant to the directions contained in the twenty-sixth section of the said Act of Parliament I have drawn up a Scheme in writing appended to this Representation describing the mode in which it appears to me that the alterations above proposed may be best effected and I do submit the same to your Grace together with the Consents in writing of the said Grosvenor Goode Knox and Kenneth Clarke to the intent that your Grace may if after full inquiry and consideration you should be satisfied with the said Scheme certify the same and such Consents by your report to His Majesty in Council."

And whereas the said Scheme drawn up by the said Bishop and the Consents referred to in the said Representation are as follows:—

"SCHEME.

"That there shall be separated from the said Vicarage of the Parish Church of Pagham and be united to and be deemed part and parcel of the said Vicarage of the Parish Church of Bognor St. John for ecclesiastical purposes all that contiguous part of the Parish of Pagham coloured green on the said plan annexed hereto and hereinafter called 'the contiguous area'.

"That the contiguous area shall be subject to the same ecclesiastical jurisdiction as the said Vicarage of the Parish Church of Bognor St. John and the Incumbent of the said Vicarage of the Parish Church of Bognor St. John shall have exclusive cure of souls within the limits of the same.

"That no part or portion of the rent charge given in lieu of tithes on the lands within the said Parish of Pagham under the provisions, of the Act for the Commutation of Tithes in England and Wales or other the endowments of the said Vicarage of the Parish Church of Pagham shall be assigned or attached to the said Vicarage of the Parish Church of Bognor St. John.

"That all fees and other ecclesiastical dues and payments for marriages churchings burials and other ecclesiastical offices solemnised and performed within the Parish or Parish Church of Bognor St. John in respect of the contiguous area shall hence forth belong to the Incumbent for the time being of the said Vicarage of the Parish Church of Bognor St. John.

"That the inhabitants of the contiguous area shall not in future be entitled to any accommodation in the said Parish Church of Pagham and shall be exonerated from all liability to repair the said Parish Church of, Pagham but shall be entitled in common with the parishioners of the said Parish of Bognor St. John to accommodation in the Church of that Parish and shall be liable subject to the provisions of the Compulsory Church Rates Act One thousand eight hundred and sixty eight jointly with the parishioners of the said Parish of Bognor St. John for the repairs of the said Parish Church of Bognor St. John.

"CONSENTS.

"We the Reverend Grosvenor Goode Knox the Vicar of the said Vicarage of the Parish Church of Pagham and The Reverend Prebendary Kenneth Clarke Vicar of the said Vicarage of the Parish Church of Bognor St. John do hereby respectively signify our consents to the Scheme above proposed and set forth and to every matter and thing therein contained. "In witness whereof we have hereunto set our hands this eighth day of September, One thousand nine hundred and thirty five.

"GROSVENOR G. KNOX. "KENNETH CLARKE.

"We Cosmo Gordon Lord Archbishop of Canterbury the Patron by virtue of Our Archbishopric of both the said benefices of Pagham and Bognor St. John hereby signify our consent to the Scheme above proposed and set forth and to every matter and thing therein contained.

"Given under our hand this eighteenth day of September, One thousand nine hundred and thirty five.

"COSMO CANTUAR."

And whereas the said Archbishop being satisfied with the said Scheme has, under the provisions of the said Pluralities Act, 1838, by his Report dated the 20th day of September, 1935, certified the same and the Consents aforesaid to His Majesty in Council to the intent that an Order may, if His Majesty in Council so think fit, be made for carrying the Scheme into effect:

Now, therefore, His Majesty is pleased, by and with the advice of His Privy Council, to order, as it is hereby ordered, that the said Scheme be carried into effect.
